AP/PTI A-I fleet expansion plan takes off as Boeing offers Rs 1,000 cr rebate Tribune News Service & PTI New Delhi, December 24 The empowered Group of Ministers (eGoM) today approved flag carrier Air-Indias (A-I) plans to purchase 68 aircraft, after securing a Rs 1,000 crore discount on the deal value from US manufacturer Boeing. Besides the huge discount on the total price of around Rs 35,000 crore, Boeing has also offered to set up MRO (maintenance, repair, overhaul) and training facilities in India at a cost of around $205 million. The eGoM has also made Boeing agree to sourcing materials from India, equal to 30 per cent of the value of the aircraft, which works out approximately to Rs 8,500 crore. After a five-hour long meeting that eGoM and A-I officials held with Boeing representatives, Civil Aviation Minister Praful Patel told reporters that the documents would now be sent to Prime Minister Manmohan Singh for final approval. The eGoM, headed by Finance Minister P. Chidambaram, has Law Minister H.R. Bhardwaj and Programme Implementation Minister Oscar Fernandes and Patel as members. Patel had a few months ago informed Parliament that the deal would cost Rs 38,900 crore which was the price prevailing at that point of time. Official sources said A-I has converted its options to buy 16 aircraft into a firm order, taking the total number of firm orders to 50. It is also acquiring 18 more aircraft for its subsidiary Air-India Express. The fleet would comprise eight Boeing 777-200 (Long Range), 15 B777-300 (Extended Range) and 27 B787s, besides 18 Boeing 737-800s for Air-India Express. The AI Board has selected engines for all 68 aircraft from the CFM International, a 50:50 joint venture between Snecma of France and General Electric Aviation of the US. While the B777-200s and 777-300s would be fitted with GE90 engines, the B787s would have GEnx engines, totalling to about Rs 4,912 crore. The B737-800s of the AI Express would be fitted with CFM56 engines at a cost of around Rs 768 crore. The fleet acquisition proposals of Air-India and Air-India Express were cleared by the Public Investment Board on October 13. While the precise calculation of the monetary concessions was being worked out, an official statement gave a break-up of the $205 million investments promised in India by Boeing and GE. The money would be used for setting up four training simulators costing (up to $75 million), MRO for Boeing aircraft (up to $100 million) and training and other civil aviation requirements ($10 million), besides GEs investment in an engine shop ($20 million). Istithmar stake in SpiceJet is $50m Dubai: Istithmar PJSC, a UAE-based investment house focusing on private equity and alternative investments, has announced that it has raised its stake in low-cost Indian carrier SpiceJet to $50 million. It invested $12.5 million in SpiceJet earlier this year, and the present stake-rise was made through the carriers recent issue of Foreign Currency Convertible Bonds (FCCB). Istithmars investment in SpiceJet, its first in India, reflected the groups long-term plans in Indias burgeoning aviation industry, news reports said. Executive Chairman of Istithmar Sultan Ahmed Bin Sulayem, said his company is extremely bullish on low-cost carriers in India with the current spate of reforms and the gradual shift to a more open skies policy. Reuters Roche, Hetero ink deal London, December 24 Swiss pharmaceutical firm Roche has signed a deal Hyderabad-based Hetero Drugs authorising it to manufacture and sell its anti-viral flu medicine Tamiflu under licence in a number of developing countries. The deal makes Hetero the second drug company after Shanghai Pharmaceutical Group to receive a sub-licence that will allow it to sell large volumes of Tamiflu at a price that it chooses. It will also be the first time Roche has authorised a partner company to produce and sell Tamiflu not only in its home market but also in other less developed and developing countries. A Roche spokesman said the deal, which initially lasts for two years, will allow Hetero to sell Tamiflu at whatever price it chooses in India and countries where there is no or poor intellectual property protection for the drug. UNI CBoP mulls acquisition Mumbai, December 24 The Centurion Bank of Punjab, the merged entity between the Centurion Bank and the Bank of Punjab, today said it is looking at further acquisition to increase its presence in the domestic market. To fund the acquisition and other expansion plans, the bank would raise up to Rs 416 crore in the overseas or domestic markets. It would also increase its authorised capital to Rs 250 crore from Rs 150 crore by issuing additional 20 crore shares to three private equity investors. Acquisition is part of our strategy. We will grab the opportunity as and when it comes, Banks Chief Executive Officer Shailendra Bhandari told PTI from Goa where the banks board held an extraordinary general meeting. He said the acquisition would aim at increasing the banks presence in the country and would be carried out in such a manner that the branches do not overlap too much. Centurion Bank of Punjab has 240 branches, mainly concentrated in the North and South. It has reasonable presence in the West and limited presence in the East. Vinayak A: Sec. 54 and 54F give exemptions from tax on long-term capital gains arising out of sale (or transfer) of a long-term asset, provided the assessee has purchased within one year before or two years after the date of sale or has constructed within three years after that date, a residential house. Now comes the amusing part. An NRI (and in some special conditions, even residents) can buy a house abroad and claim the exemption legitimately. The legislation has not added the words in India! Yet another case for CBDT. 1-by-6 category Q: Is 1-by-6 category for filing returns applicable to NRIs? Bhoumik A: Notification 10674, dated August 20, 1998 has exempted NRIs from the 1-by-6 category. It has also exempted senior citizens having no business or professional income even if they possess an immovable property. Also foreign travel to certain countries like Bangladesh, Bhutan, Maldives, Nepal, Pakistan, Sri Lanka or pilgrimages to Saudi Arabia or to China organised by Ministry of External Affairs does not fall under the 1-by-6 category. Income from NSC Q: I have purchased NSCs, which mature after six years. My question is regarding taxation thereof. Do I have to pay the tax at the time of maturity when I receive the money? That would mean a heavy burden on me and may take me to the next tax bracket also. Is there any way out? Subhash A: The income from NSC is chargeable to tax on accrual basis. It accrues only at the end of each year. The year-end is computed from the date of purchase and is not related to the end of the financial year. However, if you have failed to do so in earlier years, you may pay the tax at the end of the term (on receipt basis) but you will lose all benefit of deductions on annual interests. Section 80C Q: I invested in the Tax Saving ELSS mutual fund scheme in the month of August/ September, 2005, opting for Systematic Investment Plan (SIP). I invested an amount of Rs 5,000 per month and would thus invest a sum of Rs.35,000 by March 31, 2006. I also intend to deposit an amount of Rs.70,000 in my existing PPF account before March 31, 2006. Sumeet A: Yes, you are entitled to claim the benefit u/s 80C for the FY 05-06 for both ELSS and PPF investments. EET has not yet become a law and it is strongly felt that if and when it is enacted, it will not be with retrospective effect. Therefore, at least for FY 05-06 the old EEE system will apply. The answer to this question is similar to point 2 above. For FY 05-06, it will be EEE and for subsequent years, it will depend upon when and in what manner the law is enacted. Vinod Argekar, Muscat A: The Continent Deferred Sales Load or CDSL is reduced by the MF from the repurchase NAV and the investor gets only the net proceeds in hand. Hence, it gets automatically factored in. STT cannot be claimed by an investor as a deduction. However, if you are a trader, you can set-off the STT against your tax on trading profits. Demat charges are of two types, one charge is for dematting the particular scrip whereas the other charge is the general holding charge. The first charge can be directly associated with the scrip and hence you can claim it. The other charge needs to be apportioned over the entire portfolio and hence is that much more difficult to claim. If it is significant then the apportionment exercise may be carried on. Existing climate is conductive as common people have realised that time saved is money saved. No wonder more persons are flying through no-frills airlines. Apart from Indian, which has been a key player for decades, five private carriers Spicejet, Air Deccan, Kingfisher, Sahara and Jet Airways have been flying high. While India continues to have major market share, these private operators have been offering razor-sharp competition to each other. In a free for all, more private operators are about to join as the new year unfolds. The analysts feel that the competition will become more combative which new promotions and schemes being floated by innovative players. Imagine, Air Deccan is even eyeing for flying on NE routes to capture the market. The fares are lower but we have no problem to make the most of it, said airline officials. This is however one version of the airline industry. The other is that there are more players in the vexed airline trade than there is room for. They predict at least 50 per cent will fold or merge with each other before 2006 closes. This observation is not improbable because airline trade is a rough industry. Recently, Kingfisher Airlines has introduced special fares for the Indian armed forces, government employees and public sector personnel. Analysts says it is surprising that no carrier is offering similar kind of facilities to mediapersons. Media is a huge market now. There is indeed a boom as far as airlines are concerned. But despite new operators and routes being connected with each other, the ground situation in airports remain static. The congestion has increased manifolds and pre-flying and after flying continues to be irksome to passengers. If the passenger has to reach airport about two hours before scheduled departure, he has to wait for long to get his baggage. In all, flying is not as much comfortable as it ought to be. Flights are often delayed and then there are instances when flights are cancelled without any prior notice to passengers. Some operators are hell-bent on taking passengers for granted. Her new job is 800 miles from where she had lived while in school. The condo that her spouse had purchased a few years before they met has dropped in value. Sue and Steve would be out of pocket several thousand dollars if they sold the unit. So they decided to rent out the condo. Now they’re faced with figuring out whether, and how, to report this rental on their tax return. Does this story sound familiar? If so, you're not alone. Taxpayers in similar circumstances find themselves asking these questions: Is rental income taxable ? When do I owe taxes on rental income ? Are security deposits taxable ? What can I deduct ? When can I deduct improvements and repairs ? How do I calculate depreciation ? How do I report a rental activity on my tax return ? What are passive activities, and how do they affect me ? Is Rental Income Taxable ? Yes, rental income is taxable. But you're allowed to reduce your rental income by subtracting expenses that you incur to manage, conserve, and maintain your rental property. When Do I Owe Taxes on Rental Income? As a cash basis taxpayer (which includes nearly all individuals), you must report all income in the year you actually receive it regardless of when it was earned. If you receive rent for January 2006 in December 2005, report the rent as income on your 2005 tax return. If you receive a deposit for first and last month's rent, it's taxed as rental income in the year it's received. If you receive goods or services from your tenant in exchange for rent, you must value the goods or services at their present worth and report that value on your return in the year that they are received. You must also report income that you have received constructively . This means that you have the opportunity to receive the income. For example, if your renters place their January checks in your mailbox late in December, you cannot avoid reporting it as income simply by not removing it from the mailbox until January. Are Security Deposits Taxable ? Security deposits are not included in income when you receive them if you plan to return them to your tenants at the end of the lease. (Deposits for the last month's rent are taxable, because they are really rents, paid in advance.) What If I Pocket Some of the Security Deposit? If you eventually keep part or all of the security deposit because the tenant does not live up to the terms of the lease, you must include that amount in the income that you show on your tax return for the tax year in which the lease terminates. So you should keep track of the security deposits from year to year. This record-keeping isn't difficult if you only own one rental, but as the number of rentals you own increases, so does the paperwork. What Can I Deduct? All expenses incurred and paid by you to manage, conserve, and maintain a rental property are deductible in the year paid. Even if your rental property is temporarily vacant, the expenses are still deductible while the property is vacant and held out for rent. Deductible expenses include, but are not limited to, the following: Advertising Cleaning and maintenance Commissions Depreciation Homeowner's associations dues Insurance premiums Interest expense Local property taxes Management fees Pest control Professional fees Rental of equipment Rents you paid to others Repairs Supplies Trash removal fees Travel expenses Utilities Yard maintenance All expenses deducted must be ordinary and necessary and not extravagant. If you deduct travel expenses, you must allocate your expenses between rental and non-rental activities. For example: John, who loves to ski, owns a rental condo in Park City, Utah, which he visits in January. His travel expenses are deductible if, for example, the primary purpose of his trip is to clean and paint the unit after his tenants have moved out. If during the week, he spends three days cleaning and painting and two days skiing, he may deduct 60 percent of his travel expenses on his tax return. Keep good records. To deduct any expense, you must be able to document the deduction. That means keeping current and accurate records of your expenses paid, including all receipts, checks, and bank statements. When Can I Deduct Improvements and Repairs? Any improvements to the property must be depreciated over their useful lives (which are defined by the IRS), rather than deducted in the year paid. Improvements are actions that materially add to the value of the property or substantially prolong its life. Examples include: Additions to the structure Adding a swimming pool Installing a water filtration system Modernizing a kitchen Installing insulation Repairs, on the other hand, are deductible in the year paid. Unlike improvements, repairs just keep the property in good operating condition. Examples of repairs: Minor repainting Fixing broken gutters or floors Fixing leaks Replacing broken windows or doors For more information see IRS Topic 414: Rental Income and Expenses . How do I Calculate Depreciation? Depreciation is a deduction taken over several years. You generally depreciate the cost of property that has a useful life of more than a year, but gradually wears out, or loses its value due to wear and tear, or wind and rain, when the property is used in business, or to produce income. To figure out the depreciation on your rental property: Determine your cost or other tax basis for the property. Allocate that cost to the different types of property included in your rental (such as land, buildings, so on). Calculate depreciation for each property type based on the methods, rates, and “useful lives” specified by the IRS. 1. Determine Your Cost Basis Your cost basis in the property is generally the amount that you paid for the property (your acquisition cost plus any expenses in making the purchase). Your payment, then, includes any loan proceeds that you used to acquire the property. Review your purchase closing documents to identify any other expenses that you may deduct. Examples include: Financing costs Interest and taxes Homeowner's association dues If you are converting your property from personal use to rental use, your tax basis in the property is calculated differently. Your basis is the lower of these two: Acquisition cost The fair market value at the time of conversion from personal to rental use If the property was given to you or if you inherited it, or if you traded another property for the current property, there are special rules for determining your tax basis in your rental property. Consult IRS Publication 551, Basis of Assets , for more information about computing your tax basis in these situations. 2. Allocate the Cost by Type of Property After determining the cost or other tax basis for the rental property as a whole, you must allocate the basis amount among the various types of property you're renting. When we speak of types of property, we refer to certain components of your rental, such as the land it is built on, the building itself, any furniture or appliances you provide with the rental, etc. If your rental is a condo or other property that shares property within a community, you're deemed to own a portion of that property. Therefore, even a third floor condo is deemed to own a portion of the land and a portion of the purchase price must be allocated to the land upon which the building is built. Why this effort to divide your tax basis between property types? The different types of property are each depreciated using different rules and different lives. 3. Calculate the Depreciation for Each Type of Property Here are the most common divisions of tax basis for a rental property, followed by explanations of the different methods of depreciation. Type of Property Method of Depreciation Useful Life in Years Land Not depreciated N/A Residential rental real estate (buildings or structures and structural components) Straight line 27.5 Nonresidential rental real estate Straight line 39 Shrubbery, fences, etc. 150% declining balance 15 Furniture or appliances Double (200%) declining balance Straight-Line Depreciation In straight-line depreciation, the cost basis is depreciated (or, allocated) evenly over the tax life of the property. Example: A residential rental building with a cost basis of $150,000 would generate depreciation of $5,455 per year ($150,000 / 27.5 years). In the year that the rental is first placed in service (rented), you are allowed a deduction based on the number of months that the property is in service, with 1/2 month for the first month. In the example, if the property is placed in service in August, you are allowed a deduction for 4-1/2 months of $2,046 ($5,455 x 4.5 / 12). Declining Balance Depreciation This kind of depreciation is calculated by multiplying the rate, 150% or 200%, by the straight-line depreciation calculated based on the adjusted balance of the property at the start of the year over the remaining life of the property. To make matters somewhat easier, the IRS and others publish tables of percentages that can be applied to the original cost to determine yearly depreciation. Here's the five-year property table as an example: Year Percentage 1 20.00 2 32.00 3 19.20 4 11.52 5 11.52 6 5.76 Total 100% Example: Declining balance depreciation on furniture used in a rental with a cost of $2,400 in Year 3 would be $461 ($2,400 x 19.20%). Tables for all types of properties can be found in IRS Publication 946: How to Depreciate Property . For general information on depreciation of rentals, see IRS Publication 527: Residential Property . How do I Report a Rental Activity on My Tax Return? As an individual, you report the income and deductions for rental properties on page 1 of Form 1040, Schedule E, Supplemental Income and Loss. The total income or loss computed on Schedule E carries to Form 1040. Report the depreciation of rentals on Form 4562: Depreciation and Amortization . The instructions for these forms explain in detail how to complete these forms. TurboTax products assist you with compiling rental data and reporting the information on the appropriate lines of the appropriate forms. What are Passive Activities and How do They Affect Me? Rental properties are, by definition, passive activities and are subject to passive activity loss rules. These rules are quite complex. In general, the passive activity rules limit your ability to offset other types of income with net passive losses. In other words, if you have losses from a passive activity, such as a rental property you own, you can't always take those losses on your tax return in the current year to reduce income from non-passive activities such as wages, salary, interest, dividends, or gains from sales of stocks. Passive losses can offset income from other passive activities. If you have a net passive loss in any year, that loss is generally suspended (delayed to a later year) until either you have passive income or you completely dispose of the passive activity. But if you actively participate in a rental activity you can deduct up to $25,000 of the rental loss. To actively participate means that you own at least 10 percent of the property and you make management decisions in a significant and bona fide sense, such as approving new tenants, setting rental terms, approving improvements, and so forth. This exception isn't available to everyone. If you have modified adjusted gross income over $100,000, your maximum loss available decreases by $0.50 for every dollar over $100,000. The maximum loss is completely phased out when your modified adjusted gross income reaches $150,000. Modified adjusted gross income is determined by calculating adjusted gross income without regard to deductions for IRA contributions or pensions, taxable social security benefits, adoption assistance payments, income excluded from U.S. savings bonds used to pay higher education tuition and fees, interest on qualified student loans, the tuition fees deduction, and any passive activity loss of taxpayers in a real property business. Example: Phil and Mary have modified adjusted gross income of $90,000 and a rental loss for the year of $21,000. They actively participated in the rental. Since their modified adjusted gross income is below the limit of $100,000, their entire rental loss is deductible. If their loss had risen to $28,000, they would have been limited to a deductible loss of $25,000 this year - the balance of $3,000 would be considered a suspended passive activity loss and therefore would be "carried over" to future years' returns until completely used up. If you're married and you file a separate tax return from your spouse, and if you lived apart from your spouse at all times during the year, the maximum rental loss deduction under the exception is $12,500. Your loss begins to phase out at $50,000 instead of $100,000. If you're married, file separately, but you did not live apart from your spouse at all times during the year, the active rental real estate loss allowance is not available to you at all. You may need to complete Form 8582: Passive Activity Loss Limitations , following the published IRS instructions . If you earn your living working in a real estate arena, you may be considered a real estate professional. The passive activity rules don't apply to real estate activities for many properties owned and managed by real estate professionals. If you choose to market your property yourself, you will need to arrange to value it (many Estate agents offer free valuations, or you could value it yourself if you have a good idea of the current market in your area), negotiate a final price with the buyers, market it and show prospective buyers around your home. First impressions can count for a lot when selling a house, so keep in mind the following: Keep the outside neat and tidy. Trim bushes and trees, remove weeds, especially from driveways, and consider adding tubs of flowers or hanging baskets to the front of your property. Try and remove any clutter from the inside of your house. Generally, the less a house has in it and the tidier it is, the larger the rooms appear. Try not to cram small rooms with too many pieces of furniture. Any essential and noticeable repairs should be complete before any viewings take place. Consider whether or not you are prepared to include carpets, curtains in the price of the house, or whether you would sell them separately. What fixtures are included with the house? Generally as a rule of thumb, anything that is physically attached to the house is included as part of the house and must not be removed unless specifically excluded in the contract. Such things would include light switches, fitted kitchen appliances, curtain rails and toilet roll holders. It is adviseable to prepare a list of anything that may be considered a fixture that you are going to remove, to avoid legal problems in the future. I've decided to use an estate agent. How do I choose one? Compare things as: their reputation (if possible), whether they are members of the appropriate professional body eg NAEA (National Association of Estate Agents) and of course the commission rates. These are generally charged at 1%-2.5% of the final selling price, but they can always be negotiated lower, especially on expensive properties. You will need to check if these fees cover all costs, such as advertising, brochures, for sale board etc. Pay attention to the contract you will be agreeing with the agent. Are you agreeing to: A sole agency You can only advertise through one estate agent. You agree to pay the commission to the estate agent if they find the buyer. If you find the buyer yourself (eg through an online service) then you don't pay commission to the estate agent unless you have a contract giving them "sole selling rights" in which case you will have to pay the agent even if you find the buyer yourself. If you are going to advertise the property yourself, make this fact clear to the estate agent and do not agree to sole selling rights with him. A joint agency You employ two or more estate agents who share the commission when the property is sold.
