In House of Sand and Fog , Kathy (Connelly) gets evicted from her house for failing to pay a tax she never should have been charged in the first place. The house is swiftly put up for auction and bought by a former military officer from Iran named Behrani (Ben Kingsley, Sexy Beast ). When legal efforts fail her, Kathy turns to a sympathetic cop (Ron Eldard, Bastard Out of Carolina ), who wants out of a loveless marriage and who's willing to step over legal boundaries if it might give him a fresh start. Topnotch performances by the entire cast make House of Sand and Fog a compelling psychological drama; your sympathies will be pulled in all directions. --Bret Fetzer Product Description: Academy Award winners Ben Kingsley (Gandhi) and Jennifer Connelly (A Beautiful Mind) deliver stunning performances as two strangers whose conflicting pursuits of the American Dream lead to a fight for their hopes at any cost. What begins as a struggle over a rundown bungalow spirals into a clash that propels everyone involved toward a shocking resolution. "The surprise ending will leave you breathless!" Cunningham (Austin, Texas United States) - See all my reviews With the exception of Niki Caro's sublime "Whale Rider," no movie moved me more this past year than Vadim Perelman's "House of Sand and Fog." This story of a broken and desperate young woman who loses her house because her depression won't allow her to simply open her mail and the determined and steadfast Iranian colonel who strives to secure a better life and future for his family is a cacophony of raw emotion and heartbreak. Further, it is a meditation on what is important in life and how easy it is--no matter the intentions--to forget that very thing. This is a movie that is well photographed, beautifully adapted from Andre Dubus III's Oprah-approved novel of the same name and stunningly helmed by first time feature director Perelman. But "House" is a film that is anchored by its performances. There is hardly a false note in the acting (Ron Eldard occasionally seems overwhelmed by the powerhouse actors who surround him, however his work is still convincing). Jennifer Connelly conveys Kathy Niccoli's despair wonderfully. You can feel the depression wholly consuming her. Ben Kingsley is superb! The scene in the hospital near the end of the film is a master class in acting. Kingsley's work is brave throughout the film--he allows the audience to see Colonel Behrani's flaws and hold him accountable for them while also helping us to understand that his ambition, his dreams and desires are to serve the needs of his family. It is among the most dynamic work by an actor in any year. As fine as Kingsley is, however, my favorite performance of last year and now one of my favorites of all time has to be the stunning work by the invaluable and flawless Shohreh Aghdashloo. In her role as Behrani's patient and loving wife Nadi, Aghdashloo is grace under pressure. I dare you to catch this marvelous actress acting. She is the heart and soul of this film. It is through her expressive eyes that we understand what is at stake and what a home and family truly means. In dialogue that blends Farsi and broken English, Aghdashloo's Nadi is heard loud and clear, there is no mistaking anything she is thinking or saying. Let's face it: the Academy screwed up royally by awarding Renee Zellweger the Best Supporting Actress Oscar for her Granny Clampett-ish Ruby in "Cold Mountain" (I say this completely realizing that Zellweger singlehandedly saved "Cold Mountain" from its own pretention). The devastatingly beautiful Aghdashloo far and away claimed the prize with the superlative work she delivers in each and every scene she steals. Here is hoping that Hollywood keeps this major, major talent working for years and years to come. Buy/rent "House of Sand and Fog," which also boasts a very fine performance by young actor Jonathan Adbout as Kingsley and Aghdashloo's son, Esmail. Despite its heavy subject matter, it is a dynamic piece of filmmaking complete with some of the best performances of last year. This film haunted me for weeks after I saw it, and it has yet to release my thoughts completely. A job well done! Was this review helpful to you? Mazza (Pittsburgh, PA USA) - See all my reviews "House of Sand and Fog," directed by Vadim Perelman, is based on a novel by Andre Dubus III. The film stars Ben Kingsley as Col. Behrani, a former Iranian military officer under the Shah who now lives with his family in the United States. He buys a house from a government source, not knowing that the property was improperly seized from its prior owner (Jennifer Connelly). This bureaucratic nightmare sets up a personal conflict that drives the film. "House" is a beautifully crafted film, rich in detail and visual impact. But what really makes it shine are the excellent performances. Connelly makes her wounded character's pain palpable. As the colonel's wife, Shohreh Aghdashloo brings out both the inner lamb and lioness of the character. Frances Fisher brings a steely authority to her small but memorable role as an attorney. But it's Ben Kingsley who most impressed me. He gives a rich, multifaceted, full-bodied performance; he explores his character's aspects as husband, father, warrior, businessman, and immigrant in a way that creates a memorable and believable person. I found some plot points to seem a bit forced and hard to believe, but overall the superb craftsmanship of the film and its amazing performances really carry "House." This is a drama with moments of shocking intensity, as well as scenes of fierce anger and searing pain. But there are also scenes of real compassion and tenderness. It's a powerful story and a compelling use of the motif of the immigrant experience in America. Was this review helpful to you? I enjoyed the way this film was photographed. This movie was based on the book by Andre Dubus III. Faithful readers will notice the difference as the film takes on a different perspective, concentrating on both rivals, rather than the family as a whole. Take a star away for that reason. Overall, its still a powerful movie to watch. Was this review helpful to you? That describes how unbelievably good this movie is. The Lord of the Rings: Return of the King over this gem? Is that a joke? How didn't this even get nominated? Sean Penn over Ben Kingsley? Now that is pathetic! Sean Penn's accent is so thick you can barely even understand what he's saying! Ben Kingsley here has given one of those unforgettable performances you'll never see again. His performance is to me the 2nd best ever behind Billy Bob Thorton in the unforgettable Sling Blade. This gem is one of the most tragic ever and in the end, well, I was crying. I felt demolished and I was so sucked in by this masterpiece that I wanted to kill certain characters. This is the first movie that I've seen with Ben Kingsley and I can't belieeve how remarquable he is! Gene Hackman is nothing compared to this man. He put all of his emotions into this movie and made me feel for him. Hands done, this is the saddest and most tragic movie that I have EVER seen. Now for the plot. Kathy (Jennifer Collony) is a young lady living in California. She's got a nice house and a good life (or so we're led to believe). That soon changes though when her house gets reposessed because of not payed taxes. She is furious at these "false?" accusations. While she's trying to get it back, enter an Iraqui man, ex colonel and his wife and son. He buys the house at a very low price to make a huge profit. His family is living a wonderful and sweet life, and their tradtions are adorable. But, lil' Kathy here is still mad. And her wonderful body has attracted a police officer. And he's following here complete orders. What follows is a gem of a movie carried by Ben Kingsley's masterful perfomance. This is one of those rare movies that come along once in a decade. So, please tell your friends and everyone you know to watch this wonderful gem. Its box office is lousy, much like every masterpiece, besides Titanic of course. (I'm just joking, I hope you realized that, Titanic is horrid) Was this review helpful to you? ( Report this ) 2 of 6 people found the following review helpful: Gandhi Does LA , October 13, 2005 Reviewer: R. A Rubin (Eastern, PA United States) - See all my reviews I'm beginning to believe that Ben Kingsley is from a desert kingdom. There's sand between my teeth from his recreations of Gandhi, or in this case, one of the Shah's men. He's very good, and so is Jennifer Connelly who I last saw in an overwrought film that the elitist scum of Hollywood liked, Requiem for a Dream. Don't bother with that one unless you enjoy dizzy spells and adult toys, but in HOSAF, based on a most un-Hollywood premise, Connelly's sad face is perfect. HOSAF is not a comedy and is not aimed at fifteen-year-olds. Kingsley is a proud ex-colonel from Iran used to wealth and prestige, but now he is in exile in California. He wears a suit to work, but changes in a restroom into workers garb, because he is reduced to working as a road-gang, ditch digger and a part-time gas station jockey. He's saving every penny he makes and wins a house in an auction. Unfortunately, the County made a mistake and they took the house away from Connelly, a depressed twenty-something, ex-drug abuser. She should have opened her mail and after eviction, her lawyer and new boyfriend start a campaign to evict the Iranian family. Neither Connelly nor Kingsley is portrayed unsympathetically. They are fleshed out with pathos. This is a parable about ethical business and the consequences of our actions. Was this review helpful to you? ( Report this ) See all 252 customer reviews... Roughly chronological, using archival footage intercut with recent interviews, a story takes shape of Bob Dylan's (b. 1941) coming of age from 1961 to 1966 as a singer, songwriter, performer, and star. He takes from others: singing styles, chord changes, and rare records. He keeps moving: on stage, around New York City and on tour, from Suze Rotolo to Joan Baez and on, from songs of topical witness to songs of raucous independence, from folk to rock. Who doesn't have their own private Dylan? The true excellence of Martin Scorsese's achievement lies in how his documentary shakes us free of our comfortable assumptions. In the process, it plays out on several levels at once, each taking shape as an unfailingly fascinating narrative. There is, of course, the central story of an individual genius staking out his artistic identity. But along with this Bildungsroman come other threads and contexts: most notably, the role of popular culture in postwar America, art's self-reliance versus its social responsibilities, and fans' complicity with the publicity machine in sustaining myths. All of these threads reinforce each other, together weaving the film's intricate texture. Scorsese's 200-plus-minute focus on Dylan's earliest years allows for a portrayal of unprecedented depth, with multiple angles: a rich composite photo is the result. The main narrative has an epic quality: it moves from Dylan growing up in cold-war Minnesota through Greenwich Village coffeehouses and the Newport Folk Festival, climaxing in the controversial 1966 U.K. tour that crowned a period of unbridled and explosive creativity. In his transition from Robert Allen Zimmerman to Bob Dylan, we observe him concocting his impossible-to-describe, unique combination of the topical with the archaic, like an ancient oracle. Scorsese was able to access previously unseen footage from the Dylan archives, including performances, press conferences, and recording sessions. He also uses interviews with Dylan's friends, ex-friends, and fellow artists, and, intriguingly, with the notoriously reclusive Dylan himself (who looks back to provide glosses on the early years), fusing what could have turned into a tiresome series of digressions and tangents into a powerful whole as enlightening, eccentric, contradictory, and ultimately irreducible as its subject. Some of the deeply personal bits remain unrevealed, but Dylan's preternatural self-assurance acquires a slightly self-deprecating, even comic edge via some of his reflective comments. Alongside the arrogance, we see touching moments of the young artist's reverence for Woody Guthrie and Johnny Cash. Joan Baez, in a poignant confessional mood, comes off well, and the late Allen Ginsberg is so seraphically charming he almost steals the show a few times. A crucial throughline is Dylan's hunger for recognition and ability to shape perceptions so that would be singled out as not just another dime-a-dozen folk singer. It's illuminating--particularly for those familiar with the artist's latter-day aloofness on stage--to see his reactions to audience booing in the wake of his "betrayal" in this fuller context. No Direction Home also makes clear--in a way that wasn't possible in D.A. Pennebaker's iconic Don't Look Back --how Dylan's ability to manipulate his persona always, at its core, protects the urge for expression: Dylan's ultimate mandate, as an artist, is never to be pinned down. As Scorsese masterfully shows, the myth around Dylan only grows bigger the more we discover about him. --Thomas May DVD features : This two-disc set of Scorsese's full two-part documentary includes treats such as Dylan working on a song at his hotel during the UK tour as well as performing several songs as in concert or on TV. Minton - See all my reviews Found this at The Rogovoy Report (He is a cultural critic for WAMC Northeast Public Radio) I've seen the complete No Direction Home Martin Scorsese documentary, upcoming on American Masters on PBS in a couple of weeks (9/26-27), and it's really great. I didn't realize that it includes extensive new interview footage with Bob Dylan himself, appearing in his most straightforward, seemingly normal role EVER -- even more than on the 60 Minutes interview with Ed Bradley -- normal enough almost to take him at his word on his extensive comments on particular songs, his background, incidents in his career, etc. The film includes terrific interviews with dozens of key figures from Dylan's life and career, including Izzy Young, Harold Leventhal, Joan Baez, Paul Nelson, Bob Neuwirth, Al Kooper, Bruce Langhorne, Pete Seeger, Mark Spoelstra, Suze Rotolo , and fortunately, Allen Ginsberg and Dave Van Ronk when both of them were still around. The film also includes a tremendous amount of vintage film clips, concert footage, and still photography, a lot of which I've never seen before -- and I think I have had access to most if not all of the unofficial stuff circulating from that era. It even includes footage from postwar Hibbing, as well as early recordings (some of which of course are reflected in the companion CD "soundtrack"). It includes a lot of Newport Folk festivals and "Eat the Document" era concert and incidental footage in the best quality I've ever seen or heard any of it, and a lot that I don't think was included in the original ETD. The home DVD version also includes extensive full-song versions of concert songs that will not be screened on TV. More important than all these parts, the sum total is a fascinating "interpretation" of how Robert Allen Zimmerman became Bob Dylan up through and including summer 1966, weaved subtly by master filmmaker Scorsese simply through vintage clips, interviews, and really smart editing. The way Scorsese handles the combination of interviews and songs reminds me of The Last Waltz, but he does an even better, more subtle (and more complex) job here. I think it's as valuable a document that has ever been made about Bob Dylan -- as valuable as any book or biography, including Chronicles itself. Now, if only Scorsese spent equal time and effort on 1966-2006, but I imagine that's not likely to happen..... I've gotten some feedback already that Scorsese didn't originate this project and had nothing to do with the original footage, but of course that doesn't matter -- the point is he and/or his team organized it in a way that makes it a coherent narrative, and one with a particular point of view that has the imprimatur of Bob Dylan himself. For those who take issue with that, I suggest, as Dylan himself said all those years ago, eat the document. Was this review helpful to you? Morrison (Texas) - See all my reviews I was very frustrated by the lack of credible reviews, so I hunted down a review from the UK Observer newspaper: "Bob Dylan is a private man who is notoriously camera shy. The TV interview he gave around the publication of his autobiography, Chronicles, last year was his first in two decades, so there was some surprise when Martin Scorsese announced he was making the definitive TV biopic with the man's full co-operation. It seems that in his sixties, Dylan - who has spent so much of his career laying false trails and telling downright lies about himself - has decided it's time to set the record straight and get his version of his life and times on the record, both in print and on film. And Scorsese, who directed The Last Waltz, the 1977 film about Dylan's former backing group, the Band, was the obvious man to do it. Almost four hours long, No Direction Home deals only with the early part of Dylan's career, ending in 1966 and the tumultuous world tour on which he was booed by folk purists unable to accept his new-found rock'n'roll ways. It airs on BBC2 next month and is a riveting piece of film-making that draws on wonderful contemporary footage, much of it previously unseen, as well as revelatory new interviews. Scorsese and his team also turned up a treasure trove of unreleased music, which constitutes the latest volume in the 'official bootleg series' Dylan launched in 1991 to combat the pirates who have conferred on him the dubious honour of being the most bootlegged artist in history." I have no qualms with it. Rather, my problem lies with the extra DVD of 'performances.' I thought, when I bought it, that I'd be able to watch entire filmed performances. This is not the case - the 'performances' are simply the same clips from the documentary, not full performances. So, this is false advertising. Beware. Was this review helpful to you? I first started paying close attention to his legacy of work around the turn of the century, and each step of the way I feel more and more respect for what he accomplished and his willingness to take risks and navigate against the current many times. The documentary "No Direction Home - Bob Dylan" by Martin Scorsese, only underscores further what a fantastic artist Dylan is. It follows him from his early days until the time right before his motorcycle accident in 1966, jumping between footage of interviews with the artist, friends, colleagues and people that knew him along the way, and live performances from his 1963-1966 period. Granted that the special features in the DVD set are not particularly special, the 207 minutes the 2-part documentary lasts feel like a short time, when you realize the transcendence of Dylan's work and how he broke new musical ground along the way. "No Direction Home" (a title taken from the lyrics to his classic "Like a Rolling Stone") will entertain and inform newcomers into his music and die-hard Bob Dylan fans alike, as it sheds new light on a fascinating era in our contemporary history. Martin Scorsese took the time to put together a documentary of possibly the finest writer of the 20th Century. This shows Dylan from his growing up years in Hibbing Minnesota to his coffee house years in Greenwich Village. For any Dylan fan this documentary is a must. It goes into his rise in detail and has unreleased footage of several performances. Among the performances are This Land is Your Land, which shows Dylan paying tribute to Woody Guthrie. You also hear a rare recording of Song to Woody from his very first album. You hear a Demo of his classic, Dont Think Twice Its Alright. This recording pre-dates the version from the Freewheelin Bob Dylan. The lyrics are the same as the way Peter, Paul and Mary recorded them on their album. Masters of War is live and sounds like the version on the album. I Am A Man of Constant Sorrow is certainly worth the listen.. When the Ship Comes in and Mr Tambourine Man are also very well done. The version of Blowin in the Wind is a disappointment. The second CD is loaded with electric tunes he later did. Dylan himself is interviewed as well as contemporarites such as Joan Baez and others who knew him at the time. Dylan has always been a very private individual so we finally see the man for what he really is, and what he meant to America in the 60's I would not only recommend this to Dylan fans but to any historian who wants to know about Bob Dylan. Martin Scorsese as he did with his blues series has really put a gem together Was this review helpful to you? ( Report this ) 2 of 3 people found the following review helpful: A Portrait of the Artist as An Angry Young Man , December 14, 2005 Reviewer: Trevor Seigler (South Carolina) - See all my reviews In "No Direction Home", Martin Scorsese gives us a rare look at Bob Dylan's pivotal and volatile evolution from a Woody Guthrie copycat to arguably the single most important solo artist in rock history. And he does so with enigmatic clips of the man himself, old and withered, looking back on a time when everything changed not only for himself but for the world of pop music at large. The film, which uses Dylan's 1966 British tour as a frame of reference, looks at Dylan's beginnings in the cold wilds of Minnesota, his move to New York and rise to fame in the folk circles, and the moment that he "plugged in" and revolutionized music forever. Through it all, there is the music, which really gets a better treatment than in most "musician bios". After all, it's the music that made Dylan a landmark cultural icon, and coupled with the various images he adopted over the course of the years (here seen first as a Guthrie acolyte, then a roving folkie, and finally a stoned-out rock god), it is a fitting testament to his aura and appeal. Much like "The Beatles Anthology" some ten years ago, "No Direction Home" uses archival footage and modern interviews blended together to present a seamless look at what was, and what is. Scorsese narrows his focus to the years of 1958 to 1966, during Dylan's groundbreaking debut and transformation from the darling of the folk scene to something much more. He intersperses accounts from contemporaries like Dave Van Ronk, Joan Baez, and Allen Ginsburg with footage of Dylan's performances to make a compelling portrait of an American enigma. That being said, you won't come away from the movie feeling as if you "know" Bob Dylan. Such would be impossible, because in some ways it is his mysterious aura that keeps him in the public eye. But whatever you may feel is lacking in your knowledge of the man, you will come to understand the drive behind his music all that much more. When Dylan first appeared, of course, he was taken up as the second coming of his idol, Woody Guthrie. As he relates in the film, Dylan became disenchanted with the movement and soon began looking for ways out of what he considered a barrier on his artistic growth. What you come away with is the sense not only of how he felt about his transformation to a rock sound, but also how his peers in the folk scene (many of whom praised his early work) felt and why both sides had a right to do so. Bob Dylan's life and work will always be a source of endless fascination for those continuing generations that discover him. In "No Direction Home", Martin Scorsese has given the world a fine look into his most revolutionary period, a time that saw him rise from the Boy-King of the New York folk scene to a pop icon with a poetic license unlike the groups that came before him. And in the middle of the film, Dylan shares the great secret of what fueled all these changes: "A real artist is never satisfied with what he's doing. Once you get comfortable, that's when you die artistically" (or words to that effect). And that, in the end, is the message to take away from "No Direction Home", quite possibly the finest musical biography committed to celuloid. It's a must not just for Dylan fans, but for anyone seeking to make a living as an artist. When you have a guide like Bob Dylan to lead the way, it will always be interesting. Buying a property in Spain Foreigners buying property in Spain has become very popular. The country has a pleasant, healthy climate and in recent years the local authorities have made great efforts to increase the number foreign tourists and residents. Spain now derives more of its foreign income from tourists than any other country in Europe. Due to low European interest rates, now is a good time to buy property in Spain. There is a very wide selection of standards, from farmhouses (fincas) and plots through to villas, townhouses and new apartment developments. There is no shortage of real estate agents in Spain and it pays to search out a good company who will care for your requirements. Before you buy a property in Spain you should use our website to look at the different areas then consider visiting your favourites before deciding where to buy. Many people also rent a property in that area first. Here's a simple guide to get the most out of buying a property in Spain: Set your budget limit and stick to it. Visit the property at least twice before you make a decision. Check what amenities the property has such as electricity, water, gas. Have a builder or architect examine the structure of the building. Talk to your prospective neighbours about the area. If you are unsure about a property, take photos and draw sketches to take home with you. Have your legal advisor check ownership of the property before you sign anything. Have your legal advisor check outstanding debts on the property before you sign anything Initial Costs As well as the cost of the property, the buyer will be liable for transfer tax (IVA), which at present is 6% on a second-hand property and 7% on a new one, plus 1/2% stamp duty. The property registration office will charge you a fee to change the new deeds into your name. This is usually around 300€. There will also be notary charges for copies of the 'escritura publica'. The charge is on a scale depending on the contract price. In total you should allow 10% of the purchase price for costs. It is often the case that the buyer also pays the sellers fees. Check this at the point of enquiry and it is often possible to negotiate. Banks may also charge an opening commission for mortgage loans. Annual Costs The local town hall charge IBI which is an annual real estate tax. The previous owner is obliged to give you copies of previous bills. Community charges apply when you buy a property on a community development. These cover things like maintenance, swimming pools, gardens etc. You will also be liable for a wealth tax, payable annually and based on the value of the property and a property owners income tax based on your income from the property. You should clarify these in detail with your estate agent at point of enquiry . Finance See our mortgages section here Many developers of new properties are now offering up to 80% over 20 years for non-residents. Local banks will offer anything up to 60% for European residents. Most loans are long-term and secured on the property. When seeking a loan, make sure you are aware of the interest rates and if they are fixed or floating. Banks will ask for passports, residence permits, payslips, sale contracts and copies of the title deeds. There are many advantages to taking out a loan to purchase your property, in the form of tax allowances. We have not listed them here as they are subject to fluctuation. You may need to transfer money into Spain and you need to protect yourself: When you buy a property in Spain, you will know the price of the property in Euros but you will not know the actual cost until you buy all of the currency to pay for it. This means that the property could either cost you more than you had planned (if the Euro strengthens) or the property could become cheaper (if Sterling strengthens). Recently Sterling has fluctuated more than 10% against the Euro within a matter of months, so this does deserve careful consideration. On the basis that you are buying a property and not speculating on the currency markets, it is worth fixing the exchange rate for all of your future stage payments to the agent / developer. How to fix the exchange rate: 1/ Buy all of the currency now on a "spot contract". Hold the currency on deposit and send payments when they are due from your Euro account. To do this you need to have full funds available. 2/ Buy as much currency as you can afford now (e.g. for the first 2 payments) and reserve an exchange rate for the remaining payments. To reserve an exchange rate you need to buy a 'forward currency contract'. In effect you are buying currency now but paying at a later date when you have the funds available. The exchange rate that you achieve on a "forward contract" is not quite as good as that for a "spot contract" but it does guarantee that you know the cost of the property. You will be required to pay 10% of the value immediately and the balance by the date that you have reserved the currency for. Use a specialist currency broker : As a result of extensive research idealspain are pleased to offer preferential currency transfer rates for all their clients and visitors, click here for more information . It is also advisable to speak to your new bank with regards to High Interest Sterling Accounts where your mortgage payments can be taken directly and converted on your behalf. Approx cost to buy a home at 128,000 euros or (80,000 pounds) IVA 7% Spanish VAT payable on declared property value 8,960.00 Legal fees Searches, preparing deeds and translation etc 900.00 Notary's fees Preparing escritura, registering and stamp duty 600.00 I.A.J.D Spanish tax of 0.5% of the declared value 640.00 Connection charges Water, gas, drainage, electricity etc 300.00 Plus Valia Capital Gains Tax on increased value of plot since last sold. Levied by the Town Hall 60.00 Total Approx 7,355 pounds €11.460.00 Currency Converter Legal Matters Most properties in Spain are in fact NOT registered. Most of the re-sale properties are sold by Spanish ....still.... since they earned about 100 a year from selling fruit and veg they would certainly not pay 300 to pay for their property to be registered. The only way someone may find out if how many square meters is legally theirs to sell is by investigating at the Catastral Department and Town Hall. If they have ever declared that there is a property at all. A great deal of families have never informed the Town Hall that a senior family member has deceased and therefore many sales take months to proceed to completion. There are many families with complicated backgrounds, most children believe they actually own what is and sometimes what once was their parents, sometimes resulting in an Expediente Dominio where there can be no proof of title at all. A great deal of the beautiful villas you see advertised are not registered by the builder and therefore the purchaser pays for the first registration, sometimes no licences have been issued and the seller is required to pay fines to the Town Hall. Many many properties are then registered with less than the actual square meters of built area, and a great many are not mortgageable. Most urbanisation properties now being built are of course registered first because there is a compulsory registration system in Spain for new developments but this is Urban land - not countryside. Most of the old village properties have no Title Deeds. The seller of a second-hand home should provide the following documents: The title deed of the property Receipt of payment of the real estate tax for the last year Receipt of payment of the tax on the increased value of Urban Land Certificate that any community charges (if applicable) have been paid up to date Latest copies of domestic bills so that you can take over the services such as electricity and water The seller or developer of a new property should provide you with: Deed of declaration of new construction Occupancy permit Certificate of rateable value of the property Normally, before the purchase of a property is made official, there is a prior agreement drawn up between the buyer and seller. This document will identify the two parties and set out the terms of purchase. You must seek legal advice before signing this and you must be sure that this is the property you want to buy. You can lose any deposit you have paid if you pull out of the purchase and there is a penalty clause in the contract. In the case of the seller defaulting then he has to pay twice the amount. When it comes to signing the contract, this has to be before a notary, in the form of a public deed. This ensures that the details are entered onto the public records. Insurances Fire insurance is compulsory by law when taking out a mortgage. Comprehensive household insurance is available to protect your home and contents. Life insurance can be taken out to guarantee payment of the loan in the case of death. The cost of property - trends Official figures for the Costa del Sol state that property prices will increase this year by 12-15%. It is claimed that an average new property with two bedrooms in a block now costs 241,000 euros (around 2,000 euros per square metre). An average villa costs 388,100 euros. On the Costa del Sol there are around 20,000 homes for sale, 40% of which is in the Marbella area. 75% of home buyers on the Costa del Sol are foreign. The increase in prices is leading to an increase in the number of smaller, cheaper municipalities springing up, away from the coast. Tax advantages for property owners If you spend more than six months a year in Spain, you are obliged by law to apply for a residents permit.* This law is currently being abolished. There are however, several tax advantages for residents of Spain that do not apply to non-residents. Inputted income tax is an annual tax on an imaginary income resulting by virtue of ownership of a property and is charged as 0.5% of the catastral value. If you are a resident you will not be charged this on your principal home. Wealth tax is a tax on all assets in Spain and is charged at 0.2% of the catastral value of any house owned. For residents the first 108,000€ is exempt and for a joint ownership this would apply to each partner. These two taxes are paid annually as long as you own the property. Non-residents do not receive any relief so therefore have to pay 0.7% of the catastral value every year. When you come to sell the property, capital gains tax will be charged on any profit you have made. This is 35% for non-residents but only 20% for residents. A further concession for residents is that if you are over the age of 65 and have lived in your property for at least three years, you are totally exempt from capital gains tax. Finally, if you are 60 years of age or more and have lived in your property for at least three years, you can bequeath your property to your spouse or children and avoid paying inheritance tax on 95% of the valuation. The inheritor must also be a resident of Spain and agree not to sell the property for at least ten years. WSI - Start Your Own Business and Profit from the Internet!
