Hire a real estate broker to sell your home and one of the first things he'll likely suggest is hosting an open house, so potential buyers can casually check out your property on a weekend afternoon. While open houses are promoted as a great way of finding a buyer, a National Association of Realtors study found that their success rate is a mere 2%. No matter. Having an open house serves another important purpose — for the broker. "It gives him a database of clients," says Sean McNeill, an independent real estate broker based in New York City who says that he doesn't like open houses, preferring to match clients with appropriate buyers. "At open houses, you get all kinds of people walking in. Some are [trying] to see how much they should sell their own places for; others just want to get a look at what's out there." All are perfect pickings for a broker looking to increase his roster of buyers and sellers. "Think about it," McNeill says. "The broker is devoting a couple hours of a weekend. He won't do that unless it helps him in a big way." 2. "My fees are negotiable." Brokers like to make it sound as if their fees are engraved in stone, but that's rarely the case — especially in a brisk market, when brokers fiercely compete for properties they can unload fast. This past summer one broker in the Midwest says he lowered his fee by a full percentage point because there was so much demand for good properties that he needed leverage. Indeed, says the broker, who asked not to be named, sellers should shop around for broker's fees. He suggests these negotiating tactics: "If somebody's willing to commit to me for selling one place and buying another, I give a discount. If you're in a particularly desirable neighborhood with a house that will bring a lot of traffic" — say, at an open house — "that can be used, because the broker will use the flow of people to get potential customers. And with some [smaller] brokers, all you need to do is ask and they'll lower the commission." 3. "Think you've had no offers? Actually, there've been several." Legally, the broker you hire to sell your home is obligated to tell you about all offers that come in. In reality, some don't. Perhaps he thinks the offer is insultingly low for you, but more likely, "the broker thinks it's too low for his own purposes. He wants to hold out for a bigger commission," says McNeill. Or else there's an outside broker (or "co-broker") circling your house, and the primary broker is waiting for one of his own clients to make an offer so he can keep the full 6% to himself. "You must be clear with your broker that you want to be informed of all offers," McNeill says. "Otherwise, you may be leaving him to make decisions that you should be making." Check the listing agreement drawn up when you hire the broker; if the promise to disclose all offers isn't listed explicitly, insist that it be added. 4. "I talk about you behind your back." You spot your dream house as you're driving through a neighborhood and call the broker listed on the For Sale sign. That's how a lot of buyers stumble on a broker — who, in turn, happily shows you other houses, asking about your needs, laughing at your jokes. It's easy to get loose-lipped and forget whom you're dealing with: someone else's agent. "Legally, brokers are obligated to provide their sellers with any information that can help them get the best prices for their homes," says Stephen Israel, president of Buyer's Edge, a Bethesda, Md.-based company that represents homebuyers. "If you tell the broker that you're willing to pay $500,000 but want to offer $450,000, they'll pass that on to the seller. They have to." Also, some brokerage companies encourage prospective buyers to get preapproved for loans. While that can make a buyer more attractive to a lender, it also tells a broker whether a buyer can afford a $600,000 house when he's trying to haggle on a $400,000 property. "When somebody asks for [a preapproval], find out who they're representing," says Israel, acknowledging that such details can short-circuit your negotiating leverage. "If they represent a seller — or someone in their office does — they shouldn't have it. The broker may tell you she will be impartial, but how can she be?" 5. "Sometimes I forget whose side I'm on." The past 10 years have seen the proliferation of the buyer broker, agents who are supposed to work strictly in the buyer's interest, helping him get a fair price on a home as well as avoid pitfalls along the way. Unfortunately, things don't always unfold so nicely. While buyers may think they're getting a broker who isn't commission-hungry, many buyer agents are just that: They usually get about 3%, the same amount any broker typically earns when he gets involved with another agent's listing. "Buyer brokers are sometimes too focused on closing the sale and getting that commission," says Max Gordon, an Overland Park, Kan.-based real estate broker and attorney, so it's often in their best interest to see you pay as high a price as possible. Even worse, some brokers who call themselves buyer advocates are actually working for companies that also represent sellers. "Brokerages offer bonuses to buyer agents if they sell an in-house listing," says Israel. A good way to get a broker who has no such conflicts of interest: The National Association of Exclusive Buyer Agents, whose Web site (www.naeba.com) can help you find a buyer agent near you who pledges to help you get the best deal possible and has no ties to sellers' agents; many even work on a fee structure rather than on commission. FCIC: Borrower's Guide to Home Loans Borrower's Guide to Home Loans Introduction Before you borrow money on your home's equity, think twice so you don't end up paying more than you expected. As part of AARP's Campaign Against Predatory Home Lending , AARP prepared this Borrower's Guide for you. We don't want you to be the next person who says, "They Didn't Tell Me I Could Lose My Home." AARP's Borrower's Guide gives you information that can help you get the best possible loan and avoid bad, or predatory, loans. People borrow on their homes for many reasons-to make repairs or improvements, to consolidate debts, to pay off medical bills, or something else. Sometimes there may be benefits to using your home equity when you borrow. But if the loan costs too much, the benefits disappear ... and so might your home. Remember: Get the facts before a bad loan gets you. Getting the Best Loan Possible Sometimes a home equity loan is a good way to borrow money, but there are some lenders that only bring problems. Predatory home mortgage lenders look for people who may have financial difficulty. They hunt for people who may be behind on property taxes, who need to fix up their home, or who need money for medical bills. Once they find these people, the lenders often use highpressure sales talk, high interest rates, outrageous fees, and repayment terms that the person can't afford. Fast talkers can trick homeowners into taking out loans that they can't afford to pay back. When they can't make the payments, their homes are at risk of foreclosure. Even if you don't have financial troubles, no one wants to pay more than is needed. Why pay interest rates higher than you need to? Why pay unneeded fees or charges? Whether you have excellent credit or not-sogood credit, you want the best possible loan you can get. Don't be fooled by loan offers you see on television or receive in the mail. They don't tell the full story. Be a smart borrower. Don't get caught in a bad loan! Follow these steps: Know your credit rating and credit score. Sometimes people who have good credit are charged higher rates and fees for loans because they don't know that their credit is good. Getting your credit report and credit score may help you negotiate the best loan for you so you don't pay more than you should have to pay. You'll want to look for any mistakes in your credit report and take steps to correct them. You can get your credit score on the Internet, usually for a fee, or a lender can give you a free copy when you apply for a loan. Avoid lenders who won't give your score to you. Most credit scores range from 300-850, and the higher the score, the better your credit. Most lenders consider scores over 700 as "good" to "excellent" scores. The three major credit reporting agencies are: Equifax: (800) 685-1111, www.equifax.com ; Experian: (888) 397-3742, www.experian.com/consumer ; and TransUnion: (800) 916-8800, www.transunion.com/index.jsp . For More Information AARP Webplace: Credit Scores and Credit Reports Check Your Credit Report Credit Scores: Before You Borrow Be cautious about using a home equity loan to consolidate credit card debts. Loan offers may tell you how you can save money by paying off credit cards with a home equity loan, but what they don't say is that your home is at risk if you do it. Yes, sometimes this type of loan is useful, but only if the loan's terms are very good-and you won't run up another credit card bill. Even then, if something should happen and you can't make the home equity payment, your home is at risk of foreclosure. An important difference: Credit card lenders can't foreclose on your home if you don't pay your credit card bills. But, a home equity lender can foreclose if you don't make the mortgage payment. Shop around. Get several offers and pick the loan that's best for you-not one that is best for the lender or broker. Use the worksheet on page 11 to help you pick the best loan offer you can get, and Know whether you want a loan or a line of credit. Talk to several lenders-not just those who send you mail, call you, or knock on your door. Start with several banks, savings and loans, credit unions, and mortgage companies. Understand the role of brokers if you decide to use one. Brokers charge you to find a lender; they don't lend the money themselves. Some lenders also pay the broker and then pass their cost on to you as a higher interest rate. Since you are paying the broker either directly or indirectly, using a broker may not get you the least expensive loan. Ask all lenders to explain in detail the loan plan they have for you. Pay close attention to the fees. Remember-the loan with the lowest monthly payment might not be the best deal. There could be hidden fees that may cost you more in the end. See a housing counselor to discuss your options. You can locate counselors certified by the U.S. Department of Housing and Urban Development (HUD) by calling 1-888-466-3487 or visiting the HUD Web site at http://www.hud.gov/offices/hsg/sfh/hcc/hccprof14.cfm . Learn about reverse mortgages. For homeowners age 62 or older, this may be a better option than a home equity loan. These are loans you don't have to pay back as long as you live in your home. With a reverse mortgage you can get a lump sum of money, a monthly income, a credit line, or a combination of payment options. Close your deal carefully . Once you've found the loan you want, make sure you get the deal you were promised. Follow these steps: Read the loan papers carefully before you sign. Ask a lawyer, housing counselor, or a trusted friend to help you go over the papers. Be sure you understand exactly what the lender is offering -and what you're going to have to pay. Ask to have all fees explained. Ask questions if you don't understand something. Take your time. Don't be rushed. Be sure that all blank spaces are filled in on all copies before you sign. Know your options about credit life insurance. Only buy it if you really need it. Many people don't. If you do want it, shop elsewhere for the best terms. If the lender insists on it, find another lender. Be sure to look for this item on the forms given you at settlement. If what you read in the loan is not what you wanted or expected, don't sign the papers! Be prepared to walk out of the settlement (closing) if you find surprises. Tip: To Reduce Unwanted Credit Offers call 1-888-567-8688 or 1-800-353-0809 and ask all three credit reporting agencies Equifax, Experian, and TransUnion not to provide information about you to companies wanting to send you loan offers. Know your legal rights and use them. You have a legal right to know: The total cost of borrowing the money (fees and interest); The annual percentage rate (APR); The number of payments and the payment amounts; How long you have to pay back the loan; and The total amount you have borrowed With home equity loans, you have the right to change your mind, even after you have signed the papers. If you decide within three business days after you sign the papers that you do not want the loan, you have the right to cancel. You can cancel by sending the lender written notice of your decision to cancel by mail, hand delivery, or telegram within three business days. Saturday is a business day. For example, if you sign at 3 PM on Thursday, you have until the end of Monday to cancel. Ask for "return receipt requested" at the post office for proof of when you sent the notice. Report things that go wrong and get legal help. If you think that your lender is dishonest-for example, you discover fees that you weren't told about or you were required to buy credit insurance-report it! Call your State, County and City Government Consumer Protection Offices: (may be called consumer protection). You can find the phone number in the government listings of the phone book. Call your state Attorney General or state office of banking. You can find the phone numbers in the government listings of your phone book. Report the problem to the Federal Trade Commission (FTC) at 1-877-FTC-HELP, or at www.ftc.gov . Ask a lawyer to look at all of your documents to see if there are state or federal laws that would let you get out of the loan. Warning Signs Be cautious if anyone: Advertises or says,"Poor credit? No problem!" Calls on the phone or comes to your door offering you a "bargain loan." Rushes you to sign that day. Asks you to pay a fee "up front" to cover a first payment or other expenses. Offers you a loan with small monthly payments and a balloon payment that you'll have difficulty paying when it comes due. If You're Over 61, a Reverse Mortgage May Be a Better Choice for You A reverse mortgage is a home loan that you do not have to pay back for as long as you live in your home. It can be paid to you in one lump sum, as a regular monthly income, or at the times and in the amounts you want. The loan and interest are repaid only when you sell your home, permanently move away, or die. Eligible Homeowners All homeowners must be at least 62 years old. At least one owner must live in the house most of the year. Eligible Homes Single family, one-unit dwelling. Two-to-four unit, owner-occupied dwelling. Some condominiums, planned unit developments or manufactured homes. NOTE: Cooperatives and most mobile homes are not eligible. How They Work Most require no repayment for as long as you live in your home. They are repaid in full when the last living borrower dies, sells the home, or permanently moves away. Because you make no monthly payments, the amount you owe grows larger over time. By law, you can never owe more than your home's value at the time the loan is repaid. You continue to own the home, so you must pay the property taxes, insurance, and repairs. If you fail to pay these, the lender can use the loan to make payments or require you to pay the loan in full. What You Get and How Much You Get Reverse mortgages can be paid to you: - All at once in cash; - As a monthly income; - As a credit line that lets you decide how much you want and when; - In any combination of the above. The amount you get usually depends on your age, your home's value and location, and the cost of the loan. The greatest amounts typically go to the oldest owners living in the most expensive homes getting loans with the lowest costs. Most people get the most money from the Home Equity Conversion Mortgage (HELM), a federally insured program. Types of Reverse Mortgages Loans offered by some states and local governments are generally for specific purposes, such as paying for home repairs or property taxes. These are the lowest cost reverse mortgages. Loans offered by some banks and mortgage companies can be used for any purpose. The Cost of a Reverse Mortgage The costs for loans from banks and mortgage companies usually include the following: - Application fee - Insurance - Origination fee - Monthly service fee - Closing costs - Interest These costs are usually added to the loan balance (what you owe). HECM loans are almost always the least expensive reverse mortgage you can get from a bank or mortgage company, and in many cases are significantly less costly than other reverse mortgages. Reverse mortgages are most expensive in the early years of the loan and generally become less costly over time. Before getting a reverse mortgage other than a government or HECM loan, carefully consider how much more it will cost you. What Else You Must Know The federal government requires you to see a federally-approved reverse mortgage counselor as part of getting a HECM reverse mortgage. Every year, people spend billions of dollars for home improvements. Usually the work is done well, but each year many homeowners are victims of poor, overpriced, or never-completed work. Some people posing as home repair specialists are simply con artists looking for easy money. Others are "front men" for predatory lenders. If you are planning on making repairs or improvements to your home, it is important to pick the right contractor and the right financing. Here's how. Identify what you want done and how much you can afford. Write a detailed description of the work you want done, including the quality of materials, brand names and model numbers you want to be used. Know how much you can afford to borrow and repay. Take time to find a reliable home improvement contractor. Get recommendations from friends, family and neighbors. Check with the State, County and City Government Consumer Protection Offices or Better Business Bureau to see if there are any complaints against the contractor. However, having no complaints filed is no guarantee of reliability. Have the contractor prove he is licensed, bonded, and has insurance. Check that information with local government offices. Get two or three written estimates that give details about materials, labor charges, and start and finish dates. Use the worksheet to help you ask the right questions to compare the bids you get. Remember: A clear and detailed contract can protect you if something goes wrong. In general, a contract should spell out who does what, where, when, and for how much. Don't be pressured to get your financing through a particular company. Be cautious of financing offered by the contractor. Dishonest mortgage brokers anc contractors often work together to take advantage of homeowners. Get several estimates for the financing, apart from the contractor's estimate. Ask a lawyer or housing counselor to explain all the terms of the financing agreement. Know your legal rights. You can cancel the home repair contract by sending a letter within three business days, if the contract was signed in your home or somewhere other than the contractor's permanent place of business. You can cancel the financing by sending a letter within three business days, and maybe even later, if your home is used as security for the loan. If you think your contractor or lender is fraudulent, notify the police, the local consumer protection agency, your state Attorney General, and state/city office of banking. Contact a lawyer. You may be able to sue the contractor or lender using state or federal laws. Warning Signs Be cautious if contractors: Sell door-to-door; Call you by your first name and act friendly. Say they are doing work "up the street" or "in the neighborhood." Claim to have left over material fro another job. Talk fast to confuse you or pressure yore to sign immediately. Glossary Adjustable Rate Mortgage (ARM): A home loan where the interest rate can go up or down during the time you are repaying the loan. Annual Percentage Rate (APR): The cost of a loan expressed as a percentage rate. It includes both the interest rate on the loan and many of the costs in getting the loan. APRs are the best way to compare loans. Balloon Payment: This is the very large payment that is due at the end of some loans. A balloon payment means that the borrower's monthly payments are used to pay the interest on the loan and that little of the payment is used to pay back the amount that was borrowed. Unless you know how you will make this payment, these loans can be risky. Bid: A written estimate of what your home improvement project will cost. Closing Costs: All of the "other" costs that you have to pay when borrowing money. They could include fees for credit reports, land survey, appraisal, title search, title insurance, document preparation, notary, points, credit life insurance, and attorney fees. Credit Insurance: An insurance policy (such as life, disability, or unemployment) that pays the lender the balance of the loan if something happens to the borrower before the loan is paid off. Sometimes the lender adds the entire price of the policy to the amount you are borrowing and this is very expensive because you pay interest on that amount. Credit Report: Credit bureaus collect information about your credit history-where you owe money, how much you owe, your credit cards, and your payment history. Lenders determine whether to give you a loan and how much to charge you based on information in your credit report. Credit Score: Your credit score is a number that is used by lenders to decide whether to give you credit and at what cost. It is based on information in your credit report. Equity: The difference between what your house is worth and what you owe on it. For example, if your house is worth $150,000 and you owe $100,000, your equity is $50,000. Fraud: Dishonest business practices that lead to your doing something against your best interest. Housing Counselor: Counselors can help you explore your options, find a loan, and explain loan documents. They also offer help with foreclosure problems. The Department of Housing and Urban Development (HUD) certifies housing counselors. Installment Payments: Partial payments made to home improvement contractors as the work is being done. Interest: The percentage rate lenders charge you for using their money. The higher the percentage, the more you pay. Line of Credit: A pre-approved amount that you can borrow. You only borrow what you need, when you need it. Mortgage Broker: A person you pay to help you find a lender. Points: Each point is 1% of the amount you are borrowing. Predatory Lenders: Lenders who take advantage of borrowers and make loans that the borrowers cannot afford. They may charge very high interest rates or fees, hide costs, or lie about loan terms. Principal: The amount of money that you borrow. Reverse Mortgage: A home loan you do not have to pay back for as long as you live in the home. Repayment of the loan is due when the last surviving homeowner dies, sells the home, or permanently moves away. Settlement: The meeting where you review and sign your loan papers. Also called a "closing." Total Amount to Repay: This is the total amount of fees, points, and all monthly and balloon payments that you will pay over the life of the loan. Lonnie Cooper, top producer at Absolute Mortgage Co., was online Wednesday, August 17 at 1 p.m. ET to discuss mortgages, the recent interest-only craze or the ins and outs of investment properties. Lonnie Cooper is a senior loan officer at Absolute Mortgage Incorporated in West Chester, Pennsylvania. Lonnie closes approximately $7 million per month in mortgage volume over the past four years. Before coming to Absolute Mortgage, he worked as a loan officer at Independence Mortgage Group and was made partner. Lonnie also owns several rental properties and can provide suggestions and solutions for being a landlord. Lonnie is a graduate of Penn State University. Our guest today is Lonnie Cooper with Absolute Mortgage Co. to answer your questions about loans, mortgages and investment properties. Let's get started! Lonnie Cooper: Lets do it. _______________________ Oaks, Pa.: How do you close so many loans each month? Lonnie Cooper: Hello Oaks, I close approximately 35-40 mortgages each month. _______________________ Washington, D.C.: Hi Lonnie, Thanks for taking my question. My husband and I have been in our house for about a year. We recently received a notice from our mortgage company that basically said our escrow amounts hadn't actually covered everything that the escrow pays for (taxes and insurance). So, we had a shortfall, and we should send in a large chunk of money so our mortgage wouldn't increase by $150 a month beginning in October. Okay. So, even if we do send in the large amount, our mortgage is still going to increase by about $70 because of our increased county taxes. Now, I'm a newbie at this, but is this normal? Does this happen to other people, etc.? Does everyone's mortgage increase when their county taxes increase? We have a 30-year fixed mortgage by the way. I'm sure I sound like a complete idiot, but any insight you could share would be great, since in the past we have had ZERO response from our mortgage company when we've had questions. Lonnie Cooper: I'm sorry to hear that you are getting zero response from them. Taxes often go up and unfortunately the lender has to re-structure your escrow account accordingly. You certainly don't sound like an idiot. _______________________ Washington, D.C.: I keep on hearing that interest only loans are a bad choice and that people are using them to afford homes they could not with a traditional 30. What do you think? Lonnie Cooper: Interest only loans are very popular right now. Unfortunately, many people are taking them for the wrong reason. If used properly by the right person, an interest only loan can make sense. In the current housing market, homes are becoming less and less affordable and an interest only loan is the only way that many people can qualify for the loan. My personal opinion is that if you can't make at least the amortizing arm payment (meaning principal and interest) then you probably are looking at too much home. _______________________ Edgewater, Md.: I am in the process of buying a house that I think we will have for a long time, but I am thinking about starting out with an interest only loan with a 7 year arm and refinancing at some point to a 30 year mortgage. Do you think this is the wrong approach? Lonnie Cooper: I do think it is the wrong approach. Rates are at an historical low. 7 years from now you very well may be looking at not only a large rate spike but also a much bigger payment when the principal is also involved. _______________________ Fairfax, Va.: I have a home equity loan and I am maxed out at $100k. I want to extend that to upgrade my house. Do I have to totally apply for a new loan or can I just ask the bank to extend the line of credit? Lonnie Cooper: Hello Fairfax, Often the lender that you have with the existing home equity loan will allow you to extend it. _______________________ Arlington, Va.: What is the best loan product for new construction that will not deliver until mid-spring 2006? We would like to lock in our rate asap but do not know what is the best. Thank you. Lonnie Cooper: Hello Arlington, Many builders have special deals with local banks and their own mortgage companies. They offer long term locks for your situation with a variety of options. Regarding the product, my answer would be the same for you even if you were closing in 30 days- Take an arm if you know that this isn't your 'long-term' home or go with a fixed if it is. _______________________ Camarillo, Calif.: What is your opinion on mortgages for retired people? Your opinion on paying cash for property or financing it? Thank you. Lonnie Cooper: Hello Camarillo, I often get asked by people in the 70's and 80's whether or not they can apply for a 30 yr mortgage. Even though lenders can discriminate for income, credit, employment etc, they can't discriminate for age. So, that being said, if you need the money take it. Mortgage money is the cheapest out there. There are reverse mortgages out there as well for retirees. They often make sense as well. "Cash is king" as they say- but if you have it and it helps you sleep at night paying for your home outright is a wonderful feeling. (Or so I've heard) _______________________ Rockville, Md.: Hi Lonnie, I am a consultant and have a 2-3 year assignment that will keep me in Baltimore during the work week. I currently own a home in Rockville and have a roommate. Recently, I have been thinking about buying a place in Baltimore and also getting a roommate there to help pay for the mortgage. What are the implications of borrowing equity from my current home to buy the new home? What are the tax implications of actually residing in both homes? -Sandra Lonnie Cooper: Hello Sandra, I try not to give out too much info on tax advice as it often varies from state to state. I believe that the other home needs to be 50 miles from your primary residence to qualify as a 2nd home. If its not, it would be viewed as a rental property- ie higher rate etc. There are definitely deductions available for rental properties - consult your CPA. _______________________ Fairfax, Va.: My primary loan is for $300,000 and is a 30-year. I am looking at getting a vacation property. What can I do to get the best rate on my second property? Lonnie Cooper: Hello Fairfax, If its a true second home aka vacation property, the rate will be identical. If there is plenty of equity in your current home you can take out a line of credit, but they are variable and prime seems to be going no where but up. Thank you. Lonnie Cooper: Hello Goshen, I was cut short on my response previously. I'd like to apologize to the submitter of that question. Some quick pros are: 1- They create a significant amount of cash flow 2- They enable you to qualify for more 'house' Cash flow enables the owner to take that difference and invest it into the stock market or pay down other non deductable debts. Cash flow for a real estate investor allows for immediate positive income. Qualifying for more house enables for example a young Doctor get into a larger home knowing that his income will be going up in the near future. _______________________ Washington, D.C.: Is this a good time to look for investment property, even though the market is about to bust? Lonnie Cooper: Investment properties are always available, but because of the national real estate buying craze the 'deals' are much harder to find. Like anything else in life, its a matter of hard work and who you know- meaning get a great realtor and an even better mortgage guy. (Okay so I'm a little biased on this one) Regarding the market bursting- many top analysts feel its going to slow down but not necessarily bust. If your question is would you be buying at the top of the market right now, I'd have to say probably. _______________________ San Diego, Calif.: What is a free float down? Lonnie Cooper: Hello San Diego, A free float down is a product that Absolute Mortgage (the company that I work for) offers along with a few others. Basically its a s simple as "if the rates go lower while you are locked in, you get the lower rate" Its a product that brings a lot of people to us and when the rates go down, people love benefitting from it. It basically makes locking in a win-win _______________________ Falls Church, Va.: Does Absolute Mortgage offer long-term interest only loans and are these available on investment properties? Thank you. Lonnie Cooper: Yes, we offers long term interest only loans. These come in quite a variety. They can be fixed/adjustables that are fixed for the first 10 years or 30 years fixed that are interest only for the first 20 years. There are some that are interest only for all 30 as well. The rates obviously vary on all of these. Yes, we have I/O loans for invest. properties as well. _______________________ Bethesda, Md.: I was looking to buy a plot of land for a second home sometime down the road. What type of land loan products are available and do you offer such a mortgage? Lonnie Cooper: Hello Bethesda, There are many land loan products out there. The majority of them are not 30 year fixed loans, but realistically if you are building on the land in the future you wouldn't want one anyway. Local banks are often the best for this. We don't offer them. _______________________ Reston, VA: Is there a hard-fast rule about refinancing? I thought there used to be a rule that if rates .5 point below your rate you would refinance. Is that still a good rule? Lonnie Cooper: Hello Reston, Thats a great question. The old 'rule of thumb' was that the rate had to be 2% lower. That is certainly no longer the case. We offer what is called a 'True No Cost" mortgage where you can refinance with no costs at all. The costs are not rolled into your principal balance- we pay them. As an example- if you have a 30 yr fixed today at 6.0% and you owe 200k then at todays rate of 5.5% it probably wouldn't make sense to refinance with a traditional closing cost loan. However with a 'True No Cost' loan at say 5.875% you'll save thousands over the life of the loan for simply signing your name. _______________________ Yardley, Pa.: Hello Lonnie, I recently purchased a new home and would like to refinance the 2nd loan for Home Improvements. How long would I have to wait in order to accomplish this? The home was purchased for $279k, but with the right repairs and can be valued at $350k. Christian Lonnie Cooper: Hello Christian, Most 2nd mortgage lenders have at least a 6 month "seasoning" rule for 2nd mortgages in that they won't let you take out a new 2nd based on your new/higher value. We have some products with no seasoning that would allow you to accomplish what you are looking for. Yardley is fairly close to West Chester, Pa. feel free to stop in. _______________________ Front Royal, Va: I have a rather high fixed rate mortgage currently and I am looking to refinance. I have one negative on my credit report which is probably a few months away from coming off which would greatly increase my credit scores. Would you recommend waiting until my credit is clean or refinancing now to take advantage of these great rates. My average score is 674 but should be in the mid 700's. Thanks. Lonnie Cooper: Hello Front Royal, Great question. You guys are full of the. With a 674, I'd recommend giving the refinance a shot now. With the right amount of equity in the property and assets in reserve you very may still be approved. _______________________ Ponte Vedra Beach, Fla.: Does Absolute Mortgage offer loans in other states and what is involved to apply as far as upfront fees (does this vary state to state or based on the loan amount or credit scores)? Would you recommend to refinance my existing mortgage for cash out or get a Home Equity Loan or Line. I currently have a 30-year Fixed at around 6% and plan on living in the home for quite some time. Thank you very much. Lonnie Cooper: Hello Wilmington, See my response above for a "True No Cost" loan. It would work great for you. The home equity lines are very popular, but most are variable and again- prime seems to be consistently going up. _______________________ Cherry Hill, N.J.: What is involved with a No Doc or stated income loan? Lonnie Cooper: Hello Cherry HIll, The question is what is not involved- We have a "True No Doc" loan in which we don't even ask if you are employed. We don't need any bank statements etc. Its just a credit score and a pulse. _______________________ Newark, Del.: Is there any tried and true rule to figure out if a home improvement project is worth doing in order to add value to your home (adding garage or addition, finishing a basement., etc.? Lonnie Cooper: Hello Newark, I don't know if there is such a rule. If you ask a contractor you may get a different answer though. In speaking with property appraisers over the years, a sure fire return is adding square footage. (As long as you don't over-improve for you neighborhood) Kitchens and bathrooms also provide the highest return for improvement projects. _______________________ Clinton, Md: If you sell a home (designated investment prop) less than 2 years after settlement, do you have to put the proceed into another investment property otherwise pay the taxes? Lonnie Cooper: Hello Clinton, This one is probably best answered by a cpa. My unoffical opinion is as follows: A 1031 tax deferred exchange can be done regardless of how long you've owned the home. If you keep the property for at least 12 months then you'll pay long term capital gains vs. short term. _______________________ washingtonpost.com: Our hour is up. These expenses, which may include interest, taxes, casualty losses, maintenance, utilities, insurance, and depreciation, will reduce the amount of rental income that is taxed. You will generally report such income and expenses on Form 1040 (PDF) and Schedule E . If you are renting to make a profit and do not use the dwelling unit as a home, your deductible rental expenses can be more than your gross rental income, subject to certain limits. Your rental losses, however, may be limited by the "at-risk" rules and the passive activity loss rules. For information on these limits, refer to Publication 925 , Passive Activities and At-Risk Rules . However, if you rent a dwelling unit that you also use as a home, your deductible rental expenses will be limited. You are considered to use a dwelling unit as a home if you use it for personal purposes during the tax year for more than the greater of: 14 days or 10% of the total days it is rented to others at a fair rental price. It is possible that you will use more than one dwelling unit as a home during the year. For example, if you live in your main home for 11 months, your home is a dwelling unit used as a home. If you live in your vacation home for the other 30 days of the year, your vacation home is also a dwelling unit used as a home unless you rent your vacation home to others at a fair rental value for 300 or more days during the year. A day of personal use of a dwelling unit is any day that it is used by: You or any other person who has an interest in it, unless you rent your interest to another owner as his or her main home under a shared equity financing agreement; A member of your family or of a family of any other person who has an interest in it, unless the family member uses it as his or her main home and pays a fair rental price; Anyone under an agreement that lets you use some other dwelling unit; or Anyone at less than fair rental price. If you use the dwelling unit for both rental and personal purposes, you generally must divide your total expenses between the rental use and the personal use based on the number of days used for each purpose. However, you will not be able to deduct your rental expense in excess of your gross rental income. If you itemize your deductions on Form 1040, Schedule A (PDF), you may still be able to deduct mortgage interest, property taxes, and casualty losses on that schedule. There is a special rule if you use a dwelling as a home and rent it for fewer than 15 days. In this case, do not report any of the rental income and do not deduct any expenses as rental expenses. Another special rule applies if you rent part of your home to your employer and provide services for your employer in that rented space.
