Welcome To North Carolina Real Estate Commission News Update Effective April 1, 2006 Gov. Easley Signs Historic Real Estate Licensing Bill On September 14, Governor Easley signed legislation making the most significant changes ever in the Real Estate License Law. Soon, salesperson licenses will be converted to (provisional) broker licenses, license applicants will be required to complete more real estate education, and persons wishing to become brokers-in-charge of real estate offices must have additional training and real estate experience. At its September meeting, the Real Estate Commission recognized the following persons and organizations who were instrumental in the passage of the legislation: • Representative Julia Howard who, with Representatives William Culpepper and Harold Brubaker, sponsored the legislation and who advocated for it on the House Floor and in committee; • Senate Majority Leader Tony Rand who sponsored a companion bill and spoke for the legislation on the Senate Floor; • North Carolina Association of REALTORS® which used its considerable resources to promote the legislation; and the Commission’s 2004 Broker-in-Charge Advisory Committee which conceived and recommended the legislation to the Commission. Commission Chairman Rick Watts concluded the proceedings by remarking that, as a result of this important legislation, “Real estate consumers will soon be served by more knowledgeable agents, and North Carolina’s real estate licensing program will be restructured to meet the needs and demands of the 21st century marketplace.” For more information about the changes in the North Carolina Real Estate License Law, please click on the following links: Summary of Changes to Real Estate License Law and Frequently Asked Questions Proposed Commission rules effective April 1, 2006 New Publications Two new publications from the Real Estate Commission are now available. Real estate licensees and interested persons may now purchase the Broker-in-Charge Guide a reference publication covering the administrative and supervisory responsibilities of brokers-in-charge of real estate offices. The 104-page volume, which serves as the text for the Broker-in-Charge course, is newly re-designed, will be updated as needed and may be purchased at a price of $10 either here on the Commission’s website or with publications order forms. Also now available is the latest addition to the Commission’s popular series of “questions and answers” brochures - Questions and Answers on: Real Estate Closings . Designed to answer many of the questions frequently asked by purchasers about residential real estate closings, the pocket-sized publication covers such topics as loan commitment letters, property inspections, title insurance, deeds, homeowner associations, and closing statements. Selling A Home This Life Advice section about Home Improvement was produced by the MetLife Consumer Education Center reviewed by the Real Estate Educators Association and the U.S.D.A. Cooperative Research, Education and Extension Service. If you've decided to sell your home, chances are you're caught up in a host of emotions. You may be looking forward to moving up to a new dream house or facing the uncertainty of a major move across country. You may be reluctant to leave your memories behind or eager to start new adventures. Whatever turbulent feelings you're experiencing right now, there are plenty of practical matters that need your attention. Keep in mind the following considerations to help the whole process go more smoothly. Time Becomes Money It's a good idea to place your home on the market as far in advance as possible of purchasing a new one. If you find a new home first and then try to sell your present home, you may wind up with two mortgages. If this does happen, ask your real estate agent or banker about a bridge loan to help you make the double payments. Lenders use the same criteria for offering bridge loans as they use for mortgages. Should you qualify for a bridge loan, beware of the expense; during the term of the loan you must continue to pay both mortgages. Shop around for the best terms. Keep in mind that when people move, sell and buy, there usually is a domino effect. Closing and moving dates have to be coordinated, and the more firmly everyone commits to a window of dates and sticks to them, the better for all involved. Put all agreements about dates in writing, and protect yourself by negotiating financial penalties for failure to comply. Check Your Curb Appeal A home that's visually appealing and in good condition will attract potential buyers driving down the street. Use this checklist to view your property through an outsider's eyes. Are the lawn and shrubs well maintained? Are there cracks in the foundation or walkways? Does the driveway need resurfacing? Are the gutters, chimney and walls in good condition? Do the window casings, shutters, siding or doors need painting? Are garbage and debris stored out of sight? Are lawn mowers and hoses preperly stored? Is the garage door closed? On the Inside Strong curb appeal will lure potential buyers inside, where you have to live up to their expectations. Fortunately, there are plenty of easy improvements you can make to your home's interior without spending a lot of money. Cleaning is No. 1. Your windows, floors and bathroom tiles should sparkle. Make sure you have clean heating and air conditioning filters. Shampoo dirty carpets, clean tubs and showers, repair dripping faucets and oil squeaky doors. Keep your home neat, clean and picked-up at all times. It may not seem fair, but a peek in the oven may be the hallmark by which a buyer judges how well you have kept up your home. Remove unnecessary clutter from the garage, basement, attic, closets and straighten stored items. Also remove any items that might make a statement that would be offensive to others who may not share your same views, beliefs or sense of humor. If your home is crowded with too much furniture, consider putting some things into storage. If a room needs a fresh coat of paint, use a neutral off-white. Think, too, about how your home smells. You may be used to the smell of a pet or cigarettes, but such odors can be a strong turn-off to others. Be certain to remove valuables such as jewelry and other items from view. It might be wise to put these items in a safe deposit box before showing your home. Finally, set a mood for the buyer. Make your house homey with live flowers and fresh guest towels in the bathroom. Place scented potpourri around the house or, on the day you're expecting a potential buyer, pop a batch of frozen cinnamon rolls into the oven for a welcoming aroma. Remember, cosmetic changes do not have to be expensive. In fact, costly home improvements do not necessarily offer a good return on your investment when you sell. It's attention to the basics—anything that says “this home has been carefully maintained”—that will help you get the price you want. Go It Alone Some homeowners decide to sell their homes themselves in order to save the commission charged by a real estate agent. The commission rate may vary, depending on where you live or what agency you choose, but it is generally upwards of 5%. However, handling your own sale means you will be responsible for placing ads, answering phones and showing your home to strangers. What's more, buyers who know you are saving on an agent's commission may offer less for your home, wiping out the financial incentive to do it all yourself. You may decide an agent's commission is a bargain the first time that a would-be buyer shows up unannounced at dinnertime. Also, be aware that a real estate agent probably knows a lot more about the business of selling a home than you do. Here are some of the advantages professional agents offer: They will help you establish a fair asking price for your home. They will promote your home to other agents and list your property in multiple listing services. A multiple listing service is a book or computer database that all real estate agents who subscribe to the service can access. Your home will get exposure to all those agents, one of whom may have the perfect buyer. They will create, pay for and place advertising for you. They will schedule appointments to show your home to prospective buyers even when you are not there. They can weed out buyers who will not qualify for a mortgage. They can refer you to sources for insurance, inspections, legal counsel and financing. They will help you negotiate with the buyer. They can make suggestions to help make your home more attractive to a potential buyer. If you decide to sell through an agent, ask friends and neighbors for recommendations. Talk to several agents before picking the one you want to work with. Taking a walk through your home with an agent should give you a feel for how that person will handle prospective buyers. Ask prospective agents how they plan to market your home. Don't sign with an agent just because he or she suggests the highest asking price. Negotiate the broker's commission prior to listing your home, and sign for a limited period of time—usually three to six months. Setting a Fair Price Naturally, you want to get top dollar for your home. But, at the same time, you don't want to scare off potential buyers with a price tag that's too high. Setting an artificially high price may cause your property to languish on the market for months. Reducing your asking price later on may lead buyers to wonder if there is something wrong with your home. Here are some of the factors to consider in pricing your home. Your location Economic conditions Supply and demand in the local housing market Seasonal influences Local schools Average home prices in the neighborhood Your home's extras -- pool, fireplace, central air, etc. To determine the value of your home, you probably will want the advice of a real estate agent or appraiser. Ask an agent to prepare a market analysis for you, showing the recent selling prices of three neighborhood properties comparable to your own. The agent can help you adjust for the unique features of your own property. Qualifying a Buyer Either you or your agent will want to quickly weed out potential buyers who cannot really afford to purchase your home. A number of factors will help determine whether or not you are wasting your time negotiating a sale. The buyer's debt and credit history The buyer's current income and employment The buyer's cash position and availability of a down payment The length of time the buyer needs before closing on your home How interested the buyer appears to be in your home versus others Seek Legal Representation When selling your home—particularly if you are selling on your own—it's a good idea to be represented by an attorney. Look for an attorney with expertise in real estate transactions. When a potential buyer puts an offer in writing and you accept it, the signed acceptance becomes the sales contract. Your attorney will be present at the actual closing to protect your interests and can assist you with the following elements of a sales contract: The sale price What is included in the sale price -- draperies, carpeting, light fixtures, heating oil, etc. The amount of the down payment The date of closing and possession date Contingencies to the sale--inspections (e.g. structural, lead-based paint, radon), required improvements, legal review of the contract by the buyer's or seller's attorney, etc. The amount and length of the mortgage loan, interest rate and time limits to secure the loan Determining which closing costs are to be paid by the buyer and which by the seller Tax Implications Selling a home can have a major impact on your federal and state tax returns. Check with your tax consultant on the factors that may affect taxes resulting from the sale of your home. For example: Whether you purchased the home or acquired it by gift or inheritance Whether you used your home partly for business or rental Costs associated with selling your home Home improvements or additions, which may help to offset capital gains The sale of your home. In certain cases you can exclude up to $250,000 in gain ($500,000 for married couples filing a joint return) on the sale of property that was your principle residence for at least two years. Generally, you can use this exclusion every two years. Congratulations! Possibly you will find some of the suggestions below useful. They would mainly apply to renting or buying a condominium in Bangkok. First of all, anyone can rent (we assume), but buying property has its limitations. Practically speaking, a foreigner can buy a unit in a condominium, but can not own free land (and houses). There may be ways around it like long-term leases of land, but you will need to have a long talk with a real estate agent, to figure out further details. For most people, buying a property takes a large chunk out of their assets and savings, and should be considered wisely. After being in a long slump (this was actually a good time to buy) prices have climbed up again to levels seen in the pre-economic crisis period (1997). At the same time, we have the feeling that rents are still much cheaper than they were 7-8 years ago, so the balance still tills in favor of renting a property rather than buying one. Of course, there are other factors involved, having a property of your own (that is paid off), gives some feeling of security, and you can modify your condominium to your own desires. When buying location is of course the most important factor. This is especially so when you expect to make a profit by selling it in the future, or if you want to rent it out to other persons. One important thing to remember : When buying a property, you will in general have to prove that you have brought in the money involved from abroad. Banks have special forms to fill out for this purpose. So when you bring in the money to a Thai bank, with the purpose of using it to buy property, be sure to make it clear to your bank. Personally with the experience we gained, we would advise against property that is not built yet (of course). At least in the recent past, some developments went broke, and quite a few people lost a lot of money. There is a problem of long-term maintainance with properties in Bangkok that you should be aware off. While essential repairs may well be done, overal appearance of a building may deteriorate in a few years time. We noticed that some properties are very well maintained, but others, once prime property, seem to be allowed to slide into second-class real estate. This of course will depend on the management of the building, and on the residents staying there. Yearly meetings (where you do have voting rights) will be held, but often the money needed to keep up a building, might be used for other purposes. Furthermore, you will have little control over what happens around your property. A garbage dump or a slum may develop just around the corner. Thai people seem to more easily accept this. As long as it looks all right inside the home, who cares what is going on outside? Because of the above reasons, it may be of value to assess properties that have been around for a few years. At least you will have an idea how the building is being maintained, and what to expect in the future. A Juristic Person (elected by the condominium owners) with staff will usually manage the building, with help from real estate management companies. Management of a building may often change, with as a side-effect that there is less long-term planning and management. Some persons, owning a unit in a condominium, will refuse to pay maintainance fees as long as they do not live there themselves. This of course is illegal, and reduces the money available for maintaining the building. From our experience, it is very difficult for a Juristic Person to force people to pay their dues. As for maintaince fees, they are usually charged by the month, and the amount is decided in the yearly meeting of the owners. A fee higher than 30 baht per meter per month, is possibly high, but all depends of course on the value of the property itself, and the need for important repairs. Actually, in Thailand, it looks like people can cough up quite a few million baht to buy a property, but then do not want to spend a few thousand baht a month to maintain the value of their property. If you own a property, you will also be liable to pay a property tax. The amount of this tax depends on the estimated value of the property. You should check how much you will have to pay, though the rate may go up in the future. Our experience tells us to expect between 10,000-20,000 baht a year for a two-bedroom unit. As for other costs, you usually will pay the 'real' price, or something close to it. This can make a substantial difference in electricity costs (as compared to when renting a property). We advise that besides a real estate agent, you use the services of a law office, before you make a property purchase. Renting Of course, you do not have all of the problems above, when you decide to rent a property instead. We would certainly advise to do just that, in case you do not plan to stay permanently (or most of the time) in Thailand. Unless you have a lot of experience in real estate, we would not advise to buy property with the hope to make a profit in the future by selling it. [that is, buying property for investment purposes] Most rented property in Bangkok and around Thailand, is fully furnished and equipped. Poor buildings will usually have second-grade furniture and facilities, while valued property will be luxuriously furnished and have a lot of facilities. Most middle to high class condominiums will have a nice swimming pool, a sauna, laundry facilities, maid services etc. You may just have to get some towels, bed sheets, and coffee mugs etc., and move in. Television, washing machine, microwave, airconditioning etc., it will all be there. You can find all this, sometimes while paying a rent of 30,000 baht a month or less (especially in the suburbs of Bangkok). So, this should be considered good value. Much cheaper accommodations are available, but we do not have a lot of knowledge or recommendations about it. [If you do plan to stay a longer time in Bangkok, you can also consider staying for months on end in one of the two star or three star hotels. You will have the benefit of a hotel like maid service, room service, 'free' airconditioning, restaurants etc. Something acceptable can usually be found in the 15,000-20,000 baht a month range. Hotels may give 10-20% discounts if you stay long time. Just one place we know about : Honey Hotel in Sukhumvit soi 19] When renting you will be subject to additional costs. First of all, the usual deposit is valued at two months of rent, and the rent for the first month (and thereafter) has to be paid in advance. Be aware that the property owner (if working through a real estate agent) will usually have to pay one month value of rent as a commission to the real estate agent). Electricity costs (free in a hotel!) can run high in Bangkok, especially during the hot season. Expect about 800-1000 Units per month when using airconditioning on 'economy mode' for a medium sized room. Cost of electricity (as charged by the electricity provider) is below 3 baht per unit, but when renting, charges may be much higher (arbitrarily). We regularly notice charges of 4 baht per unit, and recently reviewed a website of a property, charging 5.5 baht per unit. So the building owners make quite a few thousand baht of easy money each month. [Customer protection is still in its developing stage in Thailand, unfortunately, that is why there do not seem to be binding rules about expenses as mentioned] When you lease property for a long time (like 30 years or 99 years), you may save some money when signing your contract, that is, a lease for 30 years may be cheaper than buying property. However, you should be aware that you forgo the rights of owning the property. For instance, you will not have voting rights in annual meetings. How the condominium is managed will be decided above your head. Monthly costs (like electricity) will also be charged, without you having control over it. Electricity costs and maintainance fees may go up over the years slowly but relentlessly. Often they turn to real estate investing , the "safe" place to invest their money. But not so fast! Sadly, the majority of real estate investors have received little useful information and/or bad real estate investment advice. They jump right in and work extremely hard, only to lose most or all of their huge investment. "Real estate investing isn't a one-size-fits-all proposition, so it's wise to lay a good foundation before laying down your cash," explains Vena Jones-Cox, also known as the "Reliable Real Estate Expert". Over the years, she has compiled this series of steps that every real estate investor should follow: Join a Real Estate Investment Association There is no book you can read, no course you can take, and no experience you can acquire on your own that can even come close to the real estate education you'll get by spending time around people who are already buying, selling, and managing properties. The successes and failures of real-life real estate investors will teach you more (and motivate you more) than even the most complete classroom education you can find. Decide what you want in regards to your real estate investing No, that doesn't simply mean "I want to buy properties." Buying properties is simply a way to achieve your actual goals: quick cash, increased cash flow, retirement income, tax advantages, etc. Setting realistic goals for your real estate business at the outset allows you to concentrate on the properties, areas, sellers, and exit strategies that are most likely to meet those goals. Decide which real estate investment strategies will get you there most efficiently There are only five basic real estate exit strategies to choose from: retail, wholesale, lease/option, sell with owner financing, and rent. Once you have decided what you want to do (refer to step 2), your choice of exit strategies will suddenly be pretty limited. For instance, if your goal is wealth building or passive income, the retail and wholesale strategies won't work for you. If you need fast cash to pay off consumer debt or build capital for long-term investments, renting properties is the wrong way to achieve this goal. Your available real estate strategies will also be limited by your education, personality, and available assets. By the time you closely examine your goals, assets, and liabilities, you should be able to decide upon a single strategy for buying and making money from real estate properties. Determine and acquire the knowledge and skills you'll need to make your real estate investment strategies work Any basic book on a particular real estate investment strategy will show you the skill set you'll need in order to make money using that strategy. You don't need to know how tenant-landlord law works or how to manage properties if you plan to retail or wholesale, but if your strategy is to rent or lease/option, these are extremely important to know. On the other hand, some skills are vital no matter which real estate investment strategy you use. These skills include the ability to determine the value of properties, find motivated sellers, negotiate with sellers, and put your offer together. Make a list of the things you'll need to learn in order to make your strategy work, then figure out how you're going to get that information. There are endless books, workshops, home-study courses, and videotapes about virtually any real estate related topic you can imagine. Once you know what information you need, finding it will be no problem. Make lots of offers, even before you're really sure you know what you're doing Vena has taught a lot of classes to lots of new real estate investors, and she's discovered something interesting: those who haven't spent some time actually practicing looking at properties, evaluating them, and making real offers have very unrealistic ideas about what's going to happen when they do. Most beginners have preconceived ideas about the objections sellers will pose to their offers that bear no actual relationship to the objections they ultimately end up raising. They have fears about not being able to find or evaluate comparable properties. They think they'll miss the repairs the properties need when in fact they are usually fairly obvious. In a nutshell, until you've actually gotten your feet wet in the real estate market, you simply don't know what you don't know. You can't make money in real estate without making real offers, and you'll never acquire the knowledge you need to become a successful real estate investor until you get the real-life experience that only comes from making offers.
