They can be rather insulting to those of us in the real estate industry because they attempt to make us sound unnecessary, unethical and expensive. But the fact is, you really can do it yourself successfully. Cynically speaking, however, you can also fix your own car, generate your own electricity, defend yourself in court, trade your own stocks and never visit a doctor. You could probably do your neighbor's job too. One day, when everything is perfectly computerized and digital, you probably won't need a real estate agent. But for now, for the rest of us, we need the help, and that help is going to cost us. So, before you go spiraling off in your declaration of independence, ask yourself, "If it's really so easy, then why aren't all real estate transactions conducted without an agent?" You might also ask yourself if you would want to eliminate the real estate agent and take on all of his or her responsibilities when you are already bogged down with your own life in general, and especially if you haven't done it enough to do it right or do it well? Then, listen closely to your answers because we professionals in the industry are often patching up real estate transactions gone sour behind the well-meaning do-it-yourselfers. Keep in mind that I'm referring to all professionals in the industry including agents, attorneys, loan originators, title officers, processors, surveyors, tax assessors, appraisers and inspectors. But I'm referring specifically to the agent because he or she is the center in this wheel. Nationally, only three to five of every 100 home sales consists of successful "For Sale by Owner" transactions. The vast majority of those that attempt it end up hiring an agent within the first 30 days after they have realized the true cost, time and demands required for marketing and showing a home. Locally, the statistics indicate 15-17 percent of FSBOs are successful. While there are a lot of reasons for this, one of the main ones is that we have a robust seller's market with relatively low inventory. This can be quite tempting for sellers to strike out on their own because it looks easier than it is. But even the owners that sell their own homes usually sell to a buyer who has an agent paid for by the seller. The truth is that the vast majority of all real estate transactions are completed with agents involved on at least one side of the sale, and for this reason, most transactions go very smoothly. But sometimes they don't. One recent seller took the advice of a local FSBO program on pricing his home. Several programs will give you limited service for a set fee. He put an ad in the paper and sold it within three days. When the appraisal report came back he learned that he priced his home too low but was still committed to that price. Sure, he might have saved 6 or 7 percent in brokerage fees but he lost a lot more than that to the happy buyer because his FSBO consultant didn't know the market well enough. In a similar incident, a very excited couple heard of a perfect home on the market For Sale By Owner in their neighborhood. The sellers told them that they didn't want to pay any brokerage fees and proceeded to negotiate down the asking price by $9,000, which made the buyers feel special. A market analysis revealed that the starting price was already about $10,000 too high. And yet, it's going to be sold at the same market price to the buyers whether or not they have an agent paid by the seller. Recently a buyer made an offer on a duplex that was accepted with a counteroffer to increase the earnest money. Both buyer and seller agreed verbally and the only thing lacking was the buyer's signature on that change. In the meantime, the seller sold the duplex to a second buyer to get a higher price and quicker closing. He now has two accepted offers on the same property at the same time. Which party in this potential lawsuit would you like to be? Not all sellers innocently try to save money on real estate commissions. Some choose to "overlook" disclosing pertinent and sometimes legally required information to buyers because doing so might lower the final sales price or prohibit a sale indefinitely because they can't afford to fix a deficiency. How would you protect yourself without the watchful eye of an expert? Agents usually take on quite a bit of risk in marketing your house for sale or driving you around looking at homes to buy. They pay for everything up front and often don't get paid until the day it is recorded, which makes him or her, actually, quite a bargain. On the other hand, you could do it yourself. As the owner of a property on the first day of January, you are liable for paying this tax which is due for payment by October/November. Penalties or fines are added for late payment, but it is possible to arrange a monthly payment scheme. 2 - Taxe d'habitation. The occupant of the property on the first day of January is liable for paying this tax. Quite a detailed check. What is a SIRET number? Information from - www.artisan-anglais.com. The SIRET number is an identification number for each French business. It is unique to that business and legally linked to a particular person. If several people engage in similar activities at the same geographical location then each must have their own SIRET number. The SIRET number is also linked to the geographical site as well so the same legal person should get a different SIRET number if his activity takes place in several different locations. It is set up by the INSEE (Institut National de la Statistique et des Etudes Economiques ) in the framework of the system SYRENE. (Système National Informatique pour le Répertoire des Entreprises et des Etablissements) The SIRET number is made up of several different identifiers and is unique to the particular business. Companies (entreprises) who run several businesses in different areas must have a SIRET number for each business and different establishments who work individually in the same location must also have individual SIRET numbers. The SIRET consists of 14 digits. The first 9 numbers are the SIREN number for the business. The first 8 digits have no significance except for administrative purposes and to organisations such as communes, fiscal offices etc. They identify the business as well as its location on the national list. The ninth digit is a check digit and has no link to the characteristics of the type business concerned. The SIREN is only issued once and removed from the list as soon as the business ceases to function, the owner dies or the business is dissolved. As it is legally linked to an individual, it is not transferred. The second part of the SIRET number is the NIC (Numéro Interne de Classement) which consists of 5 digits. The first 4 identify the business (or one of several businesses in the case of an enterprise running several establishments) The 5th digit is another check digit to validate the complete 14 number code. All registered workers should be immatriculated with the Centres de Formalités des Entreprises (CFE) at their local Chambres de Commerce, Chambre de Métiers, Tribunaux de Commerce, or the URSSAF, Services Fiscaux, or regional office of the INSEE. The only real ways to check if someone is registered for all trades they advertise are: 1. Ask to see his/her "carte d'indentification" issued by the local Chambre de Metiers which lists the trades on the card. This is a white card with green writing on the cover, and everyone has to have one. 2. Contact the Chambre des Metiers and ask direct. 3. Ask to see insurance documents for responsabilité civile and decennial which are the two obligatory insurances in France. RENT SMART Background Rental property managers are often faced with a dilemma. On the one hand, they want to keep their units full, they want to meet their fair housing obligations and, as good citizens, they want to provide housing to people who need it. On the other hand, in order to stay in business they need to rent to people who are likely to pay their rent and maintain the property. One way to address this dilemma is with a community program that provides high-risk tenants with practical training to help them succeed as tenants. Rent Smart is a teaching guide designed to be the core of a community tenant education program. It was developed by staff from the University of Wisconsin-Extension in consultation with the Wisconsin Apartment Association, the Wisconsin Trade and Consumer Protection Division, the Tenant Resource Center, the Apartment Association of Southeast Wisconsin and other housing and tenant support groups. It was field tested in several locations before publication. What's Included? Rent Smart stresses information that can help participants succeed as tenants and avoid confrontations and legal hassles. The publication is intended for trainers and includes reproducible fact sheets and worksheets for participants as well as masters for overhead transparencies. A model certificate, designed to be awarded to participants who successfully complete the training, is also included. A key feature of Rent Smart is that it stresses learner participation. Each of the lessons is organized around a series of activities so that participants are actively involved in the learning. Materials are provided to help the instructor use the activities successfully. Local Partnership Needed In addition to the curriculum, a successful tenant education program requires a local partnership. Involvement of local rental housing providers in design and delivery of the local program is essential. When this is the case they may be willing to take greater risks with applicants who have completed the program and may even provide financial incentives such as a reduced security deposit. Involvement of local housing authorities and other tenant service providers is also essential. They have contacts with households who would benefit from the program, may be able to help design the program so it meets specific client needs and may have incentives they can provide participants. In one county an agency obtained a grant to provide a partial rent payment to participants who completed the program. In many communities, extension staff members have been available to assist in developing this partnership, developing the initial tenant education program and offering some of the instruction. Home Care: Keeping It Clean and Safe - Understanding why cleaning is important and ways to do it more efficiently 10. Communicating With Your Landlord and Neighbors - Saying what you mean and resolving conflicts. 11. Moving On: Giving Notice, Security Deposits and Evictions - Ending a tenancy properly and understanding why it is important to do so.
