On this recording, Jones doesn't mess with her trademark formula. Under Arif Mardin's cozy coproduction, Jones is supported by her writing partners, her Handsome Band, and some special guests (country legend Dolly Parton , Levon Helm and Garth Hudson of the Band , and jazz drummer Brian Blade , to name a few). Jones's Texas-twanged vocals and her sparse acoustic and electric Wurlitzer piano lines enliven the CD's 13 tracks, from the light and lively single "Sunrise" to Tom Waits 's "The Long Way Home" and the bouncy duet with Parton, "Creepin' In." Where her debut "Come Away With Me" was reminiscent of Jazz singers like Billie Holiday and Rosemary Clooney, "Feels Like Home" has more of a Gillian Welch sound to it, a feeling that's only enhanced by Jones' duet with Dolly Parton on the bouncy track "Creepin' In". But that doesn't make it any less spectacular. Jones' voice is still beautiful, her piano playing is lovely, and her backup musicians, The Handsome Band, are amazing. Fans of "Come Away" won't be disappointed, despite the change of style. Something else that you see on "Home" that you didn't get before was more of Jones writing her own songs. Most of the tracks here are co-written, but Jones did write one track, "What Am I to you", herself. I will say that Jones is no lyrical genius, but the lyrics take a backseat to the still hauntingly beautiful instrumental work, especially on "Carnival Town", which has a nice string arrangement by the album's co-producer Arif Mardin. So, to sum up: "Feels Like Home" is quite different from "Come Away with Me", but it's no less great. Jones maintains the casual, relaxed quality of her music, and leaves fans more than satisfied. I can't wait to see what she comes out with next. Judging from this album, she can continue experimenting with whatever style she wants, and she'll still produce a wonderful work of art. I remember standing around in that humid little red bathroom through almost 3 tracks (not exactly good protocol on a date) totally enraptured by the the "not quite raspy, not quite silk" quality of her voice, the seductive cadence in her rythm, and delicious instramental accompaniments. I was an immediate fan and bought her CD the next day. Norah singlehandedly branded my entire summer of 2002 as "romantic" with her first major work. So with nervous anticipation I had my first listen of this CD tonight, and without further ado, I'm so happy to report that "Feels Like Home" (in my opinion) is as good or better than "Come Away With Me". Thank you Norah! From what I know of Norah Jones, she got her musical career really moving when she moved from Texas to New York City. I'm guessing here, but if I had to ascribe a dominant geographic influence to each album, I'd say Come Away "leans New York" while Feels Like Home seems rooted more in Texas. Perhaps that's why this new album is named what it is...? The only song on this CD I didn't immediately love is "Creepin In". It moves fast, is definitively country (I'm fairly certain Dolly Parton is singing along, but I don't have the album cover), yet it's very catchy and fun (as testimony, I found myself humming it tonight in the shower). Below is a list of songs that (if you love her past work) you'll immediately adore: Sunrise: I got an advance listen to this track a couple of months ago and fell in love with it at first listen. I think it's one of the loveliest songs on the album. What Am I To You: Beautiful BB King style R&B track. Will certainly be a huge hit. When I first listened to this CD I couldn't get past this particular song. I listened to it a half-dozen times straight. Carnival Town: Mostly guitar and piano (which is when I think she's at her best), the intricacy in her luscious voice is amplified and really stands out for appreciation. In The Morning: If I decided to do what I threatened so often as a kid to do, and "ranaway", this would be the perfect song to play as I screamed out of town in some hastily acquired convertible...Rambling Anyone? Sorry...This track is intense (not loud), with a wonderful buildup and easy flowing rhythm punctuated by passionate lyrics that then break into cool but subdued R&B. Toes: Norah at her best! Dreamy and romantic, the rhythm moves unpredictably but "just right" between light and heavy. Yikes, if that's not ambigious (might make more sense to you when you hear it). Humble Me: Hauntingly lonely guitar entres this song about struggle, desperation, and forgiveness. Ooh this one is good! The Prettiest Thing: This is a slam dunk hit. A jazzy, slow rhythm that picks up in tempo and seduces you into focusing on what is probably her most romantic moment in the CD (occurs around 2 minutes 45 seconds into this track). Forgive me if this is overly dramatic (it's 2am at the writing of this review), but this song literally gave me the chills. And on that note, I'll sign off. I have listened to Jazz for many many.... many years but haven't really taken time with the Blues. She has taken some Mississippi mud and formed something I didn't expect to find. This music is timeless because she brings you back to the where Blues came from but in a clean modern setting. She is essential music in my opinion and highly undervalued as a musician. I own both of her musical ventures to date and both of these are very powerful in their simplicity, straight forwardness and honesty. As on her debut, her smoky blend of jazz, country, and classic piano pop continues to intoxicate and delight. While she doesn't stray far away from her foundations, she does show signs of growth and moderate experimentation. This CD reminds me somewhat of Willie Nelson's best work (the way he can blend Texas sawdusty outlaw country with sophisticated jazzy Reinhardtisms). Norah has an earthy groundedness that nicely counterpoints her light, breathy voice. The album opener, "Sunrise," is perfect...not only as a lovely individual track, but as the album opener. It sets a mood that is both reflective and sprightly...a little playful, but also pensive. "What Am I to You?" is a deeply felt, bluesy song, as is "In the Morning." These two cuts sandwich the picturesque "Carnival Town." Norah hits the listener right in the gut with the velvet brick, "Humble Me," but she will definitely make you smile with her Dolly Parton duet, "Creepin' In." On "Don't Miss You at All," her heart, soul, and voice let you know that her words are not really true. There's something special about Texas singers: Lyle Lovett, Willie Nelson, Buddy Holly, Janis Joplin, Roy Orbison...and Norah Jones. Assist. for Families Voting Fair Housing Information Sheet # 3 Neighbors Buying Property To Prevent The Establishment Of A Group Home Imagine the following scenario: A house in a residential neighborhood is for sale. A provider of residential services to persons with mental retardation believes that the house would be a great location for a group home for three women and submits a bid to purchase the house. Neighbors of the seller learn of the provider's interest in the home and meet to develop strategies for preventing the women from moving into the neighborhood. Eventually, the neighbors conclude that the only way to prevent the provider from purchasing the home is to submit a higher bid. The neighbors realize that none of them can afford to buy the home alone, so they pool their resources, give the money collected to one of the neighbors, and that person offers the seller $5,000 more for the home than does the provider. The seller sells the home to the neighbor acting on behalf of the group. Do the actions of the seller or of the neighbors who purchased the home violate the Fair Housing Act? The FHA makes it unlawful to discriminate in the sale or rental, or to otherwise make unavailable or deny, a dwelling to any buyer or renter because of a handicapof (A) that buyer or renter; (B) a person residing in or intending to reside in that dwelling after it is so sold, rented, or made available; or (C) any person associated with that buyer or renter. 42 U.S.C. 3604(f)(1). The FHA contains an exemption for single-family houses sold or rented by an owner, provided that the owner does not use the services of a real estate agent or broker, own more than three such single-family houses, and, if the owner is not a resident, has not completed more than one sale within a 24-month period. 42 U.S.C. 3603(b). Thus, assuming the listed conditions are met, it is likely that the owner cannot be found liable under the 3604(f)(1) of the FHA. But what of the neighbors, who banded together to buy the home in order to prevent persons with disabilities from living there? Courts that have faced this and similar scenarios have answered the question in different ways. In Michigan Protection and Advocacy Service, Inc. v. Babin , 18 F.3d 337, 344 (6 th Cir. 1994), the Sixth Circuit called action similar to that described above as "normal economic competition." The Babin court analyzed the liability of the neighbors who contributed extra funds to make the purchase possible under 3604(f)(1), specifically the "otherwise make unavailable" provision. The court explained that, in normal economic competition, every purchase of a unique commodity affects availability to others. Thus, the court concluded, finding the neighbors liable would cause the statute's reach to be overbroad, and it affirmed the summary judgment entered by the court below. A claim also was asserted against the seller and the neighbors pursuant to 42 U.S.C. 3617, which makes illegal interfering with the exercise and enjoyment of the right to fair housing. The Sixth Circuit also rejected this argument, finding that the seller was motivated purely by economic considerations and that, while the purchase of the house disrupted the provider's negotiations, it did not prevent the provider from making an even higher bid on the property. Babin, then, stands for the proposition that actions related to the purchase of property — even when taken for the sole reason of preventing the use of that property by persons protected under the FHA — is "normal economic competition" and therefore is not a violation of the FHA. Not every court that has considered the issue since the Babin decision has agreed with that proposition, however. In United States v. Hughes , 849 F. Supp. 685 (D. Neb. 1994), the court denied a motion to dismiss and found the Babin decision "plainly wrong" in suggesting that there is an economic competition exception to the FHA. In Hughes , the court determined that a lender, who agreed to finance the purchase of property knowing that the intention of the buyer was to prevent the establishment of a group home, could be liable under 42 U.S.C. 3617. The court held that a bank violates the FHA by intentionally aiding buyers in keeping a home from other purchasers because those other purchasers are or are associated with persons with mental illness: [T]rue ' economic competition' does not exist when the purpose of the competition is to deny a protected person access to housing, as opposed to securing housing for oneself or for investment purposes. In fact, it is irrational to spend money for the purpose of prohibiting someone else from living next to you, if the reason you do not wish to live next to that person is because he or she has a handicap protected by the Act.-- Hughes at 686 (emphasis in original). A third opinion on this issue adopts the Hughes analysis. In Step-by-Step v. Lazarus , No. CV-97-1006 (M.D. Pa. Oct. 17, 1997), the court, in denying a motion to dismiss, held that the FHA "does apply to a buyer who purchases a property with the intention of preventing the purchase by an entity planning to use the property as a Group Home for members protected by the Act." Id. , slip op. at 1. In reaching this conclusion, the court agreed with the Hughes reasoning and stated that normal economic considerations do not exist where the underlying intent of the purchaser is to discriminate. The court found support for this proposition in 24 C.F.R. 103.20(a), which allows the filing of a complaint against "any person" engaged in a discriminatory housing practice, and in 24 C.F.R. 100.50(b)(3), which makes it unlawful to engage in "any conduct" that denies or makes housing unavailable to persons with disabilities. As these cases demonstrate, determining the motives of a buyer, seller, or neighbors and whether such motives are legally relevant is a complex issue. On the one hand, Congress has clearly mandated an end to discrimination in housing, and a narrow interpretation of the FHA, such as in Babin , allows persons with discriminatory intent to prevent individuals with disabilities from moving into a community. On the other hand, examining the private motives to all the various parties to a real estate transaction may be both unwieldy and burdensome. Clearly, it is helpful to fair housing advocates that the reasoning in Babin — even though articulated by an appellate court — was not convincing to the next two courts to consider very similar situations. While it remains too soon to make any definitive pronouncements on the merits of the issues, it is apparent, given the holdings in Hughes and Step-by-Step , that the actions of neighbors who buy property to prevent the establishment of group homes remain subject to viable challenge under the FHA. 2005-05-13 New rules to curb surging real estate price 2@webnews ,#house#housing#estate#, 0 Housing Price /enpproperty-- New rules to curb surging real estate price Home News Center China New rules to curb surging real estate price (Agencies) Updated: 2005-05-13 10:48 China is taking a wide range of steps to curb surging real estate prices, using tax and other policies to discourage speculative dealings and ensure a supply of affordable housing, state media announced Thursday. [newsphoto] The campaign, backed by seven government agencies, shows that Beijing recognizes it needs to make cooling the housing market a nationwide priority, the official Xinhua News Agency reported. Despite the government's powerful vested interest in a thriving property market, authorities worry that too much investment is going into the construction of luxury and commercial real estate and that speculative buying has pushed prices unsustainably high. Newspapers carried a notice by the State Council, China's cabinet, ordering local governments to make controlling property prices a major part of their economic policy. Average real estate prices rose by 14.4 percent year-on-year in 2004 and by 12.5 percent in the first quarter of 2005. Shanghai had the "most shocking housing prices in China," with average costs per square meter of over 10,000 yuan ($1,200), the Xinhua report said. Many urban Chinese own their homes thanks to housing reforms years ago, but cannot afford to buy new property. And low income families are generally priced out of a market that has focused on wealthy investors while neglecting construction of budget housing. The latest effort to cool the market involve the ministries of construction, finance, and land and resources, along with the State Development and Reform Commission, the State Administration of Taxation, China Banking Regulatory Commission and the People's Bank of China, China's central bank. The policy change that drew most attention in property crazy Shanghai was one requiring payment of a business tax the rate was not given on sales of property less than two years after purchase. It takes effect June 1. Local governments were ordered to clarify prices and housing sizes before granting land use rights, to limit credit for property deals and to confine real estate developers' profits to a maximum of 3 percent. Developers who fail to build within a year after buying land will be penalized, and those that fail to build within two years after buying property would lose their rights to the land, Xinhua said. The measures follow earlier, piecemeal steps by local governments. Last month Shanghai enacted a rule requiring home owners to pay off their mortgages before selling property and extending the time buyers must wait before taking ownership to 28 days, from the previous seven. In March, it imposed a tax on sales of property owned for less than a year. The measures have definitely had an impact. In April, sales of "second hand," or previously occupied apartments in Shanghai fell between 30 percent and 50 percent, depending on the district, compared with the month before, according to industry statistics published Thursday in the newspaper Oriental Morning Post.
